24-011 1 2 ORDINANCE NO. 24-011 3 4 5 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF 6 BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 3, 7 "ZONING," ARTICLE III. "ZONING DISTRICTS AND OVERLAY 8 ZONES," SECTION 8(C)(7)(C) "FENESTRATION 9 REQUIREMENTS" OF THE LAND DEVELOPMENT 10 REGULATIONS, PROVIDING FOR CONFLICTS, SEVERABILITY, 11 CODIFICATION,AND AN EFFECTIVE DATE. 12 13 WHEREAS, the City desires to modify the requirements of transparent windows or 14 door openings on the ground-level facade to reduce the requirements from 50%to 30%; and 15 WHEREAS, the City Commission has considered the staffs recommendations and 16 reports and determines and finds that it would be appropriate to amend the Land Development 17 Regulation to reflect this change; and 18 WHEREAS, the City Commission finds that the adoption of this ordinance is in the 19 best interest of the health, safety, and welfare of the citizens and residents of the City of 20 Boynton Beach. 21 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE 22 CITY OF BOYNTON BEACH,FLORIDA, THAT: 23 Section 1. The foregoing"Whereas"clauses are true and correct and are now ratified 24 and confirmed by the City Commission. 25 Section 2. Chapter 3,"Zoning,"Article III"Zoning Districts and Overlay Zones," 26 Section 8(C)(7)(c)"Fenestration Requirements"of the Land Development Regulations of the 27 City of Boynton Beach Code of Ordinances is hereby amended as follows: 28 29 PART III LAND DEVELOPMENT REGULATIONS 30 31 CHAPTER 3. Each and every other provision of the Land Development Regulations 45 not specifically amended herein shall remain in full force and effect as originally adopted. 46 Section 4. All laws and ordinances applying to the City of Boynton Beach in 47 conflict with any provisions of this ordinance are hereby repealed. 48 Section 5. Should any section or provision of this Ordinance or any portion 49 thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not 50 affect the remainder of this Ordinance. 51 Section 6. Authority is hereby given to codify this Ordinance. 52 Section 7.
