24-016 1 ORDINANCE NO. 24-016 2 3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF 4 BOYNTON BEACH, FLORIDA, APPROVING THE 5 ABANDONMENT OF PORTIONS OF AN EXISTING UTILITY 6 EASEMENT ASSOCIATED WITH THE SHOPPES AT BOYNTON 7 BEACH DEVELOPMENT PROJECT, LOCATED AT 2202 N. 8 CONGRESS AVENUE; PROVIDING AN EFFECTIVE DATE; AND 9 FOR ALL OTHER PURPOSES. 10 • 11 WHEREAS,Jeffrey Ware, on behalf of SAB Boynton Holdings, LLC ("Applicant"), 12 is requesting the abandonment of a portion of an existing utility easement recorded in Official 13 Records Book 7149,Page 1153,of the Public Records of Palm Beach County,for the proposed 14 Shoppes at Boynton project development. The project site is a 13.096-acre parcel of property 15 generally located at the northeast corner of N.Congress Avenue and Gateway Boulevard,PCN 16 08-43-45-17-00-004-0060; and 17 18 WHEREAS,the Applicant proposes modification of a portion of the existing shopping 19 center's building, site, and infrastructure to accommodate the integration of a new grocer into 20 the shopping center; and 21 22 WHEREAS,to develop the proposed project,it is necessary to abandon portions of an 23 existing utility easement to correspond with the project's proposed modifications to the 24 existing watermain distribution system; and 25 26 WHEREAS,the City's Utilities Department has reviewed the request for abandonment 27 of a portion of the utility easement and has no objection to the abandonment; and 28 29 WHEREAS, comments have been solicited from the appropriate City Departments, 30 and public hearings have been held before the City Commission on the proposed abandonment; 31 and 32 33 WHEREAS, staff finds that the subject abandonment serves a greater public purpose 34 and recommends that the Applicant's request be approved. 35 36 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE 37 CITY OF BOYNTON BEACH, FLORIDA THAT: 38 39 SECTION 1.
