("Consultant"); and 12 WHEREAS, the City was recently issued a consent order OGC No. 23-1330, which requires 13 the City to submit a Lift Station plan to bring all of the system's lift stations into compliance with 14 standards specified in the "Recommended Standard for Wastewater Facilities" referenced in Rule 15 62-604.300(2)(g), F.A.C.; and 16 WHEREAS, the City is also required to develop a documented Capacity, Management, 17 Operation, and Maintenance (CMOM) and Asset Management program in accordance with US 18 EPA document 305-B-05-002 dated January 2005 ("Guide for evaluating Capacity, Management, 19 Operation, and Maintenance (CMOM) programs at Sanitary Sewer Collection Systems"). The 20 CMOM shall address all pipes and conflict boxes located in tidally influenced areas, subject to 21 corrosion and bedding/movement issues leading to pipe failure; and 22 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 23 best interests of the city's citizens and residents to approve Task Order No. GESUT-1C-01-25 with 24 Carollo Engineers, Inc. for Collection System Inventory, Mapping, Evaluation and Document 25 Capacity, Management, Operation, and Maintenance Program (CMOM) in the amount of 26 $497,765. 27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 28 BEACH, FLORIDA, THAT: 29 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 30 being true and correct and are hereby made a specific part of this Resolution upon adoption. 31 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 32 approve Task Order No. GESUT-1C-01-25 between Carollo Engineers, Inc. and the City for 33 Collection System Inventory, Mapping, Evaluation and Document Capacity, Management, 34 Operation, and Maintenance Program (CMOM) in the amount of $497,765 (the "Task Order"), in 35 form and substance similar to that attached as Exhibit A. 36 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby 37 authorizes the Mayor to execute the Task Order. The Mayor is further authorized to execute any 38 ancillary documents as may be necessary to accomplish the purpose of this Resolution. 39 SECTION 4. The City Clerk shall retain the fully executed Task Order as a public record 40 of the City. Other Compliance Engineering Support Activities Scope of Work Task 1—Project Management and Quality Assurance/Control Task 1 includes aspects of project and quality management to provide effective delivery of the PROJECT. Specific items included in Task 1 are detailed in the subtasks described below. Task 1.1—Project Management, Communications and Meetings The CONSULTANT will provide overall project management and communication between its staff and the CITY.The CONSULTANT will track and manage the budget, project tasks, and schedule. The CONSULTANT will attend and manage project meetings.This project anticipates as- needed progress meeting to be held in the allotted budget to facilitate coordination, review design modifications, and make decisions to keep the project moving forward. The CONSULTANT will provide monthly progress reports that identify the work that has been performed during the month and the work that is anticipated in the upcoming month. These reports will be delivered as part of the monthly progress payment request. Task 1.2—Quality Assurance/Control The CONSULTANT will coordinate quality control and quality assurance review of the project including review of design modification documents, QC of permit applications, and oversight/facilitation of communication between the CITY and FDEP. It is the CONSULTANT's understanding that several measures have already been undertaken by the City so this task will be a combination of documenting existing measures and providing additional SSO reduction measures to comply with Order requirements.Significant focus will be placed on methods by which the City can detect unauthorized discharges more rapidly.The completion date of the plan and schedule, including obtaining any necessary FDEP permit(s)or permit modification(s), shall be no later than three years from the effective date of the Order. Some of the support services provided under this task include: 1. Existing data collection and review including: a) Interviews with Operation and Maintenance(O&M)staff to determine measures already installed to address 55O detection/reduction b) Field visits will be done to provide documented evidence of said measures. c) Review of existing data, including but not limited to record drawings, condition assessment data, hydraulic model, and GIS information 2. Review of City-provided asset inventory, GIS information, hydraulic model, and condition assessment information of existing system 2. Identification of a list of deficiencies in existing system to be remedied by the City 3. Review of current projects already in progress by City to address identified deficiencies 4. One(1)workshop to discuss findings with the City 5. Recommendations to include safety elements at lifts station as part of the gap analysis for internal technical memorandum 6. Development of Lift Station Plan to bring all system lift stations into compliance 7. Coordination of asset inventory updates The CONSULTANT will provide deliverables associated with the above items. Deliverables: • TM summarizing improvements to collection system management, operations, maintenance, and capacity programs • TM summarizing hydraulic model updates • TM summarizing new condition assessment data collected and updates to AM system Task 7—Compliance Engineering Support for AM and CMOM Progress Reporting The CONSULTANT will assist the City in submitting to FDEP a written report containing information about the status and progress of projects being completed under the Order, information about compliance or noncompliance with the applicable requirements of this Order, including construction requirements and effluent limitations, and any reasons for noncompliance. Reports will be submitted every six(6) months after the effective date of the Order and continue until all corrective actions have been completed.These reports shall also include a projection of the work the City will perform pursuant to this Order during the 12-month period that will follow the report. It shall also document reasonable further progress in implementing the CMOM in accordance with sub-Paragraphs 5(c)and 5(d)of the Order. The City shall submit the reports to the Department within 30 days of the end of each six-month period ending July 31 and January 31 of each year.The City's first report shall be due February 2025. In-kind projects may either be an environmental enhancement, environmental restoration, a capital/system improvement project(Order Clause 12)or a Pollution Prevention (P2) Project(Order Clause 13), which reduces the amount of pollution that enters the environment by conserving resources (including water, raw materials, chemicals, and energy) use or by minimizing waste generation (including domestic and industrial wastewater, solid and hazardous waste, and air emissions).A P2 Project must reduce pollution or waste within the process beyond what is required by federal, state, or local law in order to be eligible for civil penalty offset under this Order. Task 8 provides services to develop in-kind projects as described in the paragraph above, should the City wish to pursue these options. Services within this task also include: 1. Review of proposed in-kind projects to proposed to FDEP 2. General coordination meetings with FDEP on Order items Schedule The scope of services outlined in this task authorization will be performed for an estimated two(2)year period from receipt of a purchase order or notice-to-proceed from the CITY. If the project task requirements are different from the assumptions presented in this Scope of Services, or if the CITY desires additional services,the resultant change in scope will serve as a basis for amending this project assignment or initiating the development of a new project assignment as agreed to by both the CITY and CONSULTANT.The following assumptions and CITY responsibilities apply to this project: The CONSULTANT shall be entitled to rely upon the accuracy of the data and information supplied by the CITY without independent review or evaluation. The CITY shall attend all workshops and review meetings to maintain the progress of the project according to the schedule. The CITY will provide the CONSULTANT with access to treatment facility for data gathering, data validation and the design process. The CITY will assist with data collection and site testing as necessary, including accompanying the CONSULTANT and leading operation of the facility. The services to be performed by the CONSULTANT are intended solely for the benefit of the CITY. No person or entity not a signatory to this Scope of Work shall be entitled to rely on the CONSULTANT's performance of its services hereunder, and no right to assert a claim against the CONSULTANT by assignment of indemnity rights or otherwise shall accrue to a third party as a result of this Scope of Work or the performance of the CONSULTANT's services hereunder. In providing opinions of cost, financial analyses, economic feasibility projections, and schedules for potential projects, CONSULTANT has no control over cost or price of labor and material; unknown or latent conditions of existing equipment or structures that may affect operation and maintenance costs; competitive bidding procedures and market conditions;time or quality of performance of third parties; quality,type, management, or direction of operating personnel; and other economic and operational factors that may materially affect the ultimate project cost or schedule.
