3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA,APPROVING A WAIVER OF RIGHT OF FIRST REFUSAL
5 FOR THE PROPERTY LOCATED AT 21 RIDGE POINTE DRIVE, UNIT C,
6 BOYNTON BEACH, FL 33435, OWNED BY LEROY A. PRESCOD AND
7 DENISE D. PRESCOD;AND FOR ALL OTHER PURPOSES.

9 WHEREAS,the property located at 21 Ridge Pointe Drive, Unit C, Boynton Beach, FL 33435,
10 is owned by Leroy A. Prescod and Denise D. Prescod and was purchased with the assistance of
11 the State Housing Initiatives Partnership ("SHIP") Program. $17,000 of the SHIP Program was
12 secured by a thirty (30) year interest-free deferred loan (second mortgage and promissory note)
13 and an Agreement for Right of First Refusal. This deferred payment loan was issued on April 21,
14 2010. The City has no interest in purchasing the house; therefore, the City has been requested to
15 waive the Right of First Refusal so the property can be transferred as an inheritance to Dale Black;
16 and
17 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
18 best interests of the city's citizens and residents to approve a Waiver of Right of First Refusal for
19 the property located at 21 Ridge Pointe Drive, Unit C, Boynton Beach, FL 33435, owned by Leroy
20 A. Prescod and Denise D. Prescod.

22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
23 BEACH, FLORIDA, THAT:
24 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
25 being true and correct and are hereby made a specific part of this Resolution upon adoption.
26 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
27 approve a Waiver of Right of First Refusal for the property located at 21 Ridge Pointe Drive, Unit
28 C, Boynton Beach, FL 33435, owned by Leroy A. Prescod and Denise D. Prescod (the "Waiver"), in
29 form and substance similar to that attached as "Exhibit A."
30 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby
31 authorizes the Mayor to execute the Waiver. The Mayor is further authorized to execute any
32 ancillary documents necessary to accomplish the purposes of this Resolution.
33 SECTION 4. Upon execution of the Waiver by the City, the City Clerk shall record the
34 Waiver in the Public Records of Palm Beach County. The City Clerk shall provide a copy of the
35 recorded Waiver to RJ Ramirez.
36 SECTION 5. This Resolution shall take effect in accordance with law.

WAIVER OF RIGHT OF FIRST REFUSAL
The CITY OF BOYNTON BEACH, FLORIDA (the "CITY"), a Florida municipal corporation, being the
owner, holder, and beneficiary of a right of first refusal recorded in Official Records Book 23813, Page
1529, of the Public Records of Palm Beach County, Florida, on any sale or resale or transfer of the real
property located at 21 Ridgepoint Drive Point Avenue, Unit C, Boynton Beach, FL 33435, hereby
acknowledges that it has been offered the following described land pursuant to its right of first refusal,
and the CITY hereby waives its right to exercise such right of first refusal to purchase the property for the
following described transaction:
Owner: Leroy A. Prescod, and Denise D. Prescod
Recipient: The property is being deeded via an inheritance to Dale Black
PROPERTY DESCRIPTION: Lot 3, Block 21, Ridge Woods Villas, as recorded in Plat Book
44, Pages 92 and 93, of the Public Records of Palm Beach
County, Florida.
If the above referenced transaction does not close,then the City's right of first refusal shall be reinstated
and shall be fully applicable to any successive transactions.
