R24-327 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF 4 BOYNTON BEACH, FLORIDA, APPROVING AMENDMENT NO. 1 TO 5 THE FY 2022-2023 ARPA SUBRECIPIENT GRANT AGREEMENT 6 BETWEEN THE CITY AND WOUNDED VETERANS RELIEF FUND 7 EXTENDING THE AGREEMENT THROUGH DECEMBER 31, 2026, 8 AND APPROVING AMENDMENT NO. 1 TO THE PROFESSIONAL 9 SERVICES AGREEMENT FOR EMERGENCY RENTAL, UTILITY, AND 10 RELOCATION ASSISTANCE PROGRAM BETWEEN THE CITY AND 11 PATHWAYS TO PROSPERITY, INC., EXTENDING THE AGREEMENT 12 THROUGH DECEMBER 31, 2026; AND FOR ALL OTHER PURPOSES. 13 14 WHEREAS,the City and Wounded Veterans Relief Fund entered into a FY 2022-2023 ARPA 15 Subrecipient Grant Agreement dated February 6, 2023, approved by Resolution No. R23-009; and 16 WHEREAS, the City and Pathways to Prosperity, Inc., entered into a Professional Services 17 Agreement for Emergency Rental, Utility, and Relocation Assistance Program dated September 18 23, 2021, approved by Resolution No. R21-131; and 19 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 20 best interests of the city's citizens and residents to approve Amendment No. 1 to the FY 2022- 21 2023 ARPA Subrecipient Grant Agreement between the City and Wounded Veterans Relief Fund 22 extending the Agreement through December 31, 2026, and approve Amendment No. 1 to the 23 Professional Services Agreement for Emergency Rental, Utility, and Relocation Assistance Program 24 between the City and Pathways to Prosperity, Inc., extending the Agreement through December 25 31, 2026. 26 27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 28 BEACH, FLORIDA, THAT: 29 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 30 being true and correct and are hereby made a specific part of this Resolution upon adoption. 31 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 32 approve Amendment No. 1 to the FY 2022-2023 ARPA Subrecipient Grant Agreement between 33 the City and Wounded Veterans Relief Fund, extending the Agreement through December 31, 34 2026 (the "Amendment"), in form and substance similar to that attached as Exhibit A. 35 SECTION 3. The City Commission of the City of Boynton Beach, Florida, does hereby 36 approve Amendment No. 1 to the Professional Services Agreement for Emergency Rental, Utility, 37 and Relocation Assistance Program between the City and Pathways to Prosperity, Inc., extending 38 the Agreement through December 31, 2026 (the "Amendment"), in form and substance similar to 39 that attached as Exhibit B. 40 SECTION 4. The City Commission of the City of Boynton Beach, Florida, hereby 41 authorizes the Mayor to execute the Amendments and such other related documents as may be 42 necessary to accomplish the purpose of this Resolution. 43 SECTION 5. The City Clerk shall retain the fully executed Amendments as a public record 44 of the City. A copy of the fully executed Amendments shall be provided to Mirna Crompton to 45 forward to the other parties. 46 SECTION 6. Lamb 82 City Attorney AMENDMENT NO 1 TO AGREEMENT BETWEEN WOUNDED VETERANS RELIEF FUND AND CITY OF BOYNTON BEACH This First Amendment to Agreement is made by and between the City of Boynton Beach ("City") and Wounded Veterans Relief Fund ("Grantee"), a nonprofit of the State of Florida, on the date last signed below. WHEREAS,the City entered into the Agreement with the Grantee for Boynton Beach Veterans Emergency Housing Assistance("Agreement"), effective February 6, 2023; and, WHEREAS,the Grantee has requested an extension to the Agreement term. NOW THEREFORE,the City and Grantee hereby agree as follows: The Agreement is hereby amended to extend the term through December 31, 2026. All other terms and conditions of the Agreement remain in effect. If and to the extent that any inconsistency may appear between the Agreement and this Amendment,the provisions of this Amendment shall control.
