I. CALL TO ORDER
Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order
at 9:09 a.m., and explained the Magistrate's role and the procedures. Pursuant to Chapter
162, Florida Statutes, all orders are appealable only to the Circuit Court in Palm Beach
County and not to the City Commission. Also, a fine will be imposed if the violation(s) are
not corrected by the deadline.

longer park on grass. Mr. Diaz requested if compliance date can be extended to February
21 , 2025 allowing 60 days to comply with violation.
Ms. Zalman inquired if the storage violation has been resolved and was provided
confirmation it was, only grass violation remains.
The City had no objection to the extension request.

Mr. Luc advised he applied for the Certificate of Use for Rental Property shortly after the
Special Magistrate Hearing. He continued to explain that the reason it has not been
complied is because when he calls the department to schedule inspection, no one
answers the phone.
Officer Chevalier Bien-Aime advised that an inspection was scheduled for November 27,
2024 however respondent cancelled the inspection. Officer Bien-Aime further explained
that respondent replaced windows without a permit thus creating a new violation that will
not allow the current violation to pass.
Mr. Luc replied that the reason he cancelled inspection was due to contractor not
appearing to replace sod many times. He then explained he replaced windows with similar
windows because it was broken. He did not know he needed a permit to replace broken
windows with similar windows.
Ms. Zalman inquired if property is a investment property and received confirmation from
both Officer Bien-Aime and Mr. Luc.
Mr. Luc was advised by Patrick Hart, Community Standards Supervisor, that he would
need a contractor to apply for a permit from the building department for the new windows
as the property is not his homesteaded property..

sent by the City notifying him of the violation. He would like to move forward with disputing
the cost.

Mr. Pache explained that his clients, the new owners, are from out of town and were not
aware of the violation, nor did they receive the notices. However, they are currently in
process of trying to rectify the violation and have obtained one (1) quote from Budget
Fence. Mr. Pache further explained that the Condo Association requires three (3) quotes
to comply with the Florida Statutes.
Ms. Zalman stated that this violation is a health and safety hazard and Mr. Pache
confirmed that the pool is locked due to its condition. He assures they are working
diligently to rectify the violation.

of violation occurred on February 15, 2005. The original Magistrate hearing date was

March 1, 2005. The fine certification hearing was on April 20, 2005, and no one appeared.
Service by certified mail and posting on the property dated March 29, 2005. The

Ms. Zalman reviewed the lien and recommended reduction.
Ms. Zalman inquired the whereabouts of (glad Naurelus. Mr. Estella answered that Mr.
Naurelus is in Haiti however he had stolen the property. According to Mr. Estella, Mr.
Naurelus had a Deed prepared in Haiti and came here to have it recorded. When Mr.
Estella tried to comply with violation, Mr. Naurelus called the police to have him removed
from property. Mr. Estella did not have access to property until he hired a Lawyer, went
to court, and had Judge eliminate Mr. Naurelus name from the Deed.
Mr. Estella stated he spent about $3000 during that time, and $4000 to replace grass.
Officer Jaiprashad informed Ms. Zalman he was not aware of the information provided by
Mr. Estella.
The City has had no communication with (glad Naurelus.
The City confirmed via the Property Appraiser website that EG Real Estate Investments
LLC is the current property owner of the property. Per Sunbiz, Guy Estela is an Officer of
EG Real Estate Investments LLC.
Ms. Zalman stated the total would be $4,370.12 to be paid within 90 days.
Decision
Due to evidence and testimony, Ms. Zalman reduced the fine to $4,370.12 total for Case
No. 05-0383 payable within 90 days or the fine will revert to the original amount.

of violation occurred on July 13, 2023. The original Magistrate hearing date was March
20, 2024, and no one appeared. Service by certified mail on January 2024. The fine
certification hearing was on May 15, 2024, and no one appeared. Service by certified mail
on April 11 , 2024. The compliance date was April 9, 2024 and the fine proposed by the
Magistrate was $75 per day, plus $384.12 administrative fees. The property was last
inspected on August 15, 2024, and the violation has complied. There have been 128
days of non-compliance at $75 per day for a total amount of $9,600.00, plus the $384.12
administrative fees for a total of $9,984.12.
Officer Jaiprashad stated that the Cityis recommendinga reduction to 1 996.82 plus
$384.12 administrative fees.
Steve Eisenband on behalf of property owner was present.
Ms. Zalman reviewed the lien and recommended reduction.
Mr. Eisenband wanted to provide a correction, he was present at the fine certification
hearing on May 15, 2024.
Mr. Eisenband explained that the property owners did not receive any notice sent by the
City as it was sent to the wrong Registered Agent. That Registered Agent received
multiple notices. The property owners were not aware of the violations until May 7, 2024,
when a notice was posted by Officer Calim Estime on the property. Within 100 days of
finding out of violations, they were able to cure all of the violations, for a total of $16,784
and had all work expedited.
Mr. Eisendband stated that the Registered Agent issue has been fixed.
Discussion ensued about possible additional reduction.
Ms. Zalman recommended that the property owner check property appraiser to make
sure the contact information is updated.
After consideration of the facts, Ms. Zalman does not believe that the City committed any
errors. Ms. Zalman stated the total would be $1 ,884.12. However, Mr. Eisendband,
although appreciative of the reduction, reiterated his request for further reduction.
Ms. Zalman wanted to match the total amount at the last hearing, which would be 15%
off the original amount which would total $1 ,497.61, inclusive of everything, to be paid
within 90 days.
Decision
Due to evidence and testimony, Ms. Zalman reduced the fine to $1 ,497.61 total for Case
No. 23-2122 payable within 90 days or the fine will revert to the original amount.

Charles Luccene, respondent, was present. Harold Charles was also present serving as
interpreter for Mr. Luccene.
Ms. Zalman reviewed the lien and recommended reduction.
Mr. Charles stated that Mr. Luccene applied for a lien reduction for this case, in which he
paid $200.00. Mr. Luccene has worked to comply with the violations as soon as he was
aware of them. This is his homestead property. It was noted that Mr. Luccene only works
part time.
Ms. Zalman provided a 15% reduction and stated the total would be $877.50 to be paid
within 90 days.
Decision
Due to evidence and testimony, Ms. Zalman reduced the fine to $877.50 total for Case
No. 23-3216 payable within 90 days or the fine will revert to the original amount.

of violation occurred on February 14, 2023. The original Magistrate hearing date was
August 16, 2023, and no one appeared. Service by via posting on August 4, 2023. The
fine certification hearing was on October 18, 2023, and no one appeared. Service via
posting on October 5, 2023. The compliance date was September 19, 2023, and the fine
proposed by the Magistrate was $150 per day, plus $384.12 administrative fees. The
property was last inspected on October 24, 2024, and the violation has complied. There
have been 401 days of non-compliance at $150 per day for a total amount of $60,150,
plus the $384.12 administrative fees for a total of$60,534.12.
Officer Hart stated that the City is recommending a reduction to $9,080.12, plus
administrative fees.
Mr. Bledi Trepca, respondent was present.
Ms. Zalman reviewed the lien and recommended reduction.
Mr. Trepca advised he appreciated the recommended reduction by the City. Mr. Trepca
explained that he had difficulties with contractor to pull permits. He stated that he also
had trouble with contractor responding to him. Mr. Trepca feels he should not be
penalized to pay fines due to contractor neglect. Mr. Trepca requested reduction to
$4,500, of the original certified fine.
In consideration of reductions, Ms. Zalman stated her concerns of the violations being a
possible health and safety hazard. She also explained that Mr. Trepca has separate
means to go against the contractor if they were causing him a delay.
Mr. Trepca stated he spent $1,600 to remove structure at $400 a day.
Mr. Trepca advised this is an investment property, he rents the property for short term
rentals.
Ms. Zalman considered a 12% reduction and stated the total would be $7,164.09,
incorporating the administrative fees, to be paid within 90 days. Mr. Trepca found the
recommendation fair.
Decision
Due to evidence and testimony, Ms. Zalman reduced the fine to $7,164.09 total for Case
No. 23-0028 payable within 90 days or the fine will revert to the original amount.
