The applicant has certified that signage has been posted and that notices were mailed in accordance with Ordinance Nos. 04-007 and 05-004. BACKGROUND The subject site consists of two parcels, each measuring 1.15 acres, for a combined total of 2.3 acres. Both parcels are zoned Single-Family Residential (R1AA) and are located at the southeast corner of the intersection of Southeast 27th Avenue and Southeast 1st Place. The northern parcel contains the existing church, which includes a sanctuary, a Sabbath school building, and a preschool building. The southern parcel serves as the associated parking lot. A Unity of Title has been submitted and processed to combine the two parcels(PZ 25-08900002). The existing development on the subject property includes a 2,019-square-foot Sanctuary building, a 4,808-square-foot Sabbath School building, and a 3,129-square-foot Pre-school building, totaling 10,956 square feet of existing structure on-site. The Sanctuary is currently connected to the existing bathrooms and Sabbath School building through the exisitng covered loggia. The applicant proposes to demolish the existing bathrooms and loggia and construct a new addition in their place. The new structure will include ADA-compliant restrooms and an enclosed connection between the Sanctuary and Sabbath School building, while also serving as the primary entrance to the Sanctuary from the parking lot to the south. The project includes related site improvements, such as ADA-accessible ramps leading to the new entrance. Pursuant to Part III, Chapter 3, Article IV, Section 5.B, of the City's Land Development Regulations (LDRs), any use or structure legally established prior to the adoption or amendment of the applicable zoning code that would now require Conditional Use approval is considered a legal nonconforming use. Such uses may become conforming upon application and approval of a Conditional Use. Staff has verified that the church received a Certificate of Occupancy in 1992, confirming that the use of church was established prior to the adoption of Ordinance No. 10-025, and is therefore eligible to seek Conditional Use approval to become conforming. 2 C\Uscrs\StanzioneT Downloads\MSPM_COUS_2025 02.0730 Staff Report_GraccPoint_SDA_Church(I)docx Page 3 GracePoint SDA Church (MSPM,COUS - 2025.02.0730) Pursuant to Part III, Chapter 3, Article IV, Section 3.D.84, additions, expansions, and improvements to legally established places of worship shall only be allowed if the subject property was under proper ownership prior to the adoption of these regulations. Ownership shall be based on the records of the County Property Appraiser's office. Based on the Palm Beach County Property Appraiser records, staff was able to verify the ownership since 1991. Furthermore, the applicant is not proposing an increase in the congregation's size or in the operational capacity with this request. The project is limited to necessary improvements to facilitate ADA compliance and accessibility. ANALYSIS Ch. 3 Art. IV. Sec. 4.C. of the Land Development Regulations (LDRs) contains the following standards to evaluate the Conditional Use application. In addition, the applicant has submitted a separate detailed justification statement that addresses each of these standards (see Exhibit "B" — Justification Statement). The City Commission shall consider only such conditional uses as authorized under the terms of the LDR's. Conditional uses may be granted as proposed or with conditions of approval including, but not limited to, the dedication of property for streets, alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding area and the citizens' general welfare, or be denied when not in harmony with the intent and purpose of the Conditional Use applicaiton. In evaluating the application, the Commission shall consider the effect of the proposed use on the general health, safety, and welfare of the community and make written findings certifying that satisfactory provisions have been made concerning the following standards, where applicable: a. Ingress and egress to the subject property and proposed structures thereon, with particular reference to automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. The subject site has access from SE 15t Place and SE 271h Court. The proposed addition is not expected to generate any potential hazards or problems. b. Off-street parking and loading areas where required, with particular attention to the items in standard#1 above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and nearby properties, and the city as a whole. The proposed addition includes a new main entrance and ADA-compliant restrooms for the church's sanctuary(auditorium). In accordance with the City's Land Development Regulations (LDRs), parking requirements for auditoriums are calculated at one space per four seats. As the project does not include any increase in seating capacity, the existing parking requirements remain unchanged. c. Refuse and service areas, with particular reference to the items in standards a and b above. A dumpster currently exists on site. No additional impacts are anticipated with this application as the new ADA bathrooms are replacing existing bathrooms. e. Screening, buffering and landscaping, with reference to type, dimensions, and character. The proposed application is to expand the existing church by 440 square feet; no changes to the buffers are being proposed. f. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and compatibility and harmony with adjacent and nearby properties. No signs or exterior lighting is being proposed. g. Required setbacks and other open spaces. The addition will not result in any setback, encroachment, or exceeding of any code requirements. h. General compatibility with adjacent properties and other properties in the zoning district. The existing use, church, is generally compatible with the surrounding residential uses. i. Height of building and structures, with reference to compatibility and harmony with adjacent and nearby properties, and the city as a whole. The addition of the church will not cause any increase in height. j. Economic effects on adjacent and nearby properties, and the city as a whole. The overall economic effects of the proposed use on adjacent and nearby properties, and the City as a whole, will be negligible, other than the enhanced condition of the property with the expanded building. k. Where applicable, the proposed use furthers the purpose and intent of a corresponding mixed- use zoning district or redevelopment plan; and. This project is not within the mixed-use zoning district and is an existing use on site. I. Compliance with and abatement of nuisances and hazards in accordance with the operational performance standards as indicated in Chapter 3, Article IV, Section 1, and the Noise Control Ordinance, and City Code of Ordinances Part ll, Chapter 15, Section 15-8. The 1.15- acre subject property (PCN#: 08-43-45-33-07-000-0180) is generally located on the South east corner of the intersection of SE 27TH Ave and SE 1St Pl. The site is currently developed with a +/- 8,600 s.f Church and 3,129 s.f daycare/Preschool. The congregation recently identified the need to improve accessibility for aging and disabled members by upgrading restroom facilities. The proposed project provides a necessary and minimal solution to enhance interior connectivity between two existing buildings—the Sanctuary to the west and the Administration, Children's, and Fellowship spaces to the east. This connection will be established through an enclosed corridor occupying the space of the current outdoor restrooms. Additionally, new ADA-compliant restrooms will be constructed to the north of this corridor, while preserving existing exterior access to the parking lot (south) and garden (north). To accomplish this, a modest 400-square-foot expansion is required. This addition has been thoughtfully positioned between the existing structures to minimize visual impact, reduce costs, and maintain harmony with the surrounding community. The subject property supports a Future Land Use (FLU) designation of Low Density Residential (LDR), and retains a zoning designation of Single-Family Residential (R-1- AA) District.
