CALL TO ORDER Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order at 9:12 a.m., and explained the Magistrate's role and the procedures. Pursuant to Chapter 162, Florida Statutes, all orders are appealable only to the Circuit Court in Palm Beach County and not to the City Commission. Also, a fine will be imposed if the violation(s) are not corrected by the deadline. II. Officer Bien-Aime stated that the shutters remaining are a health and safety hazard and needed to be taken down. Magistrate Zalman inquired how much time respondent needed for the sod. Mr. Rubio requested a 60-to-90-day extension due to the dry weather. Magistrate Zalman stated that she would provide a compliance date of June 24th, 2025, for the shutters and a compliance date of July 24, 2025, for the sod. Officer Bien-Aime stated that he previously informed the respondent that the only way to rectify the violation was to obtain a permit. Mr. Otis requested more time to obtain a contractor and the permit. Magistrate Zalman explained that she would not be providing an extension at this time as it is a health and safety hazard. She recommended they begin the permit process and contact the office once they are closer to the deadline to request an extension. Officer Bien-Aime objected to the extension requests due to a red tag notice being provided on February 25, 2025. Officer Bien-Aime provided the respondent with information on how to apply for the Business Tax Receipt. Facts about the case, there was a permit that was submitted in March and was rejected on May 19th as the wrong permit was applied for. A new permit was applied for on May 19th. He advised that he had spoken with the Fire Department and was told what he needed to do to keep the door from coming down. Officer Hart inquired if Mr. Riskas was living on the property. Mr. Riskas answered that he was not. Officer Hart explained that it is not an occupiable space as far as a living space. The initial inspection date was September 9, 2024. This is not a repeat violator. The initial notice was issued September 10, 2024, via written notice, with 30 days to comply. The notice was sent by certified mail on April 9, 2025. Signed green card dated April 22, 2025. Facts about the case, a meeting was held at City Hall with the store manager regarding the violations. The property was last inspected on May 16, 2025. This is a health and safety hazard. The City recommends a Cease-and-Desist Order effective immediately, and a fine of$150.00 per occurrence, plus administrative fees in the amount of$384.12. Magistrate Zalman inquired what the City would like the Cease-and-Desist Order to state. Officer Rivera answered that every time the City right of way is obstructed with trailers or U-Haul trucks that would be an occurrence. 10 Mercedes Moris, Manager of U-Haul location, and Angel Vega, Traffic Manager for U- Haul, were present. Magistrate Zalman reviewed the violation. Mr. Vega stated that they currently have an equipment return sign, however they are in the process of obtaining a larger sign so that this no longer occurs. Magistrate Zalman inquired how the violations were occurring. Mr. Vega answered that it is due to the after-hour drop offs when the customers are returning the equipment. Further discussion ensued regarding where the customers are dropping off trailers and U-Haul trucks. Ms. Moris inquired if the City could add an additional no parking sign. Magistrate Zalman asked Officer Hart if the respondent would need to contact the City to request an additional sign. Magistrate Zalman indicated that Officer Hart was going to put in a note for an additional sign. Magistrate Zalman advised that she will issue a Cease-and-Desist Order. She inquired if the City is asking for $150.00 to be assessed or just for future occurrences. Officer Rivera answered that it would be for future occurrences. Mr. Vega asked when they could expect the additional no parking sign to be placed. Officer Hart stated that he could not provide an answer at this time. Community Standard Director Candice Stone indicated that their return sign cannot be on the sidewalk, it would need to be located on their property. She recommended they contact the Planning and Zoning department regarding sign regulations for businesses. Regarding the additional no parking sign, she informed them that Officer Hart will contact Public Works however Public Works do not typically place the signs on every light pole. Decision Magistrate Zalman will issue a Cease-and-Desist Order plus administrative fees in the amount of$384.12. Ms. Brenda Clay, respondent, and her son were present. Magistrate Zalman reviewed the violations. 12 Ms. Clay explained that she was unaware of the violation as she had been out of town, however her son is living on the property. She stated that her son will stop working on vehicles at the property. Magistrate Zalman reviewed the compliance date with the respondent to avoid fines. Ms. Clay's son indicated that he does not run a business on the property. He is a car collector and has registrations for each of his vehicles. He would like to know where he was wrong and what he could do moving forward. Officer Rivera answered that he is not allowed to do automobile work at the property. Community Standards Director Candice Stone explained that in order to comply with violations the auto mechanic work would need to stop and all inoperable vehicles that cannot be legally driven would need to be removed from property. Ms. Clay's son indicated that everything had been removed. Ms. Stone answered that on her property survey it shows where the fence was previously installed, there was a cut across her neighbors' property. It is unclear why the City is asking for the permit. Magistrate Zalman recommended Ms. Stone set up a meeting with the Building department. Magistrate Zalman stated that she would provide an extension to July 24, 2025, to provide extra time. Ms. Stone requested further extension due to health reasons. Magistrate Zalman inquired if the City had any objections to a further extension. Officer Allen responded that he had no objection. Magistrate Zalman provided further extension to August 24, 2025. Fine Certification Case No. 24-1084 CERAC JACQUELINE AND Property Address: 110 NE 17TH AVE Property Violation(s): CO CH 15 SEC 15-120 (D) 1 B CO CH 15 SEC 15-120 (D) 1 A Officer Brandon Chevalier Bien-Aime presented this case. The Special Magistrate Hearing date was February 19, 2025, and the respondent did not appear. A compliance date was set for March 25, 2025, or a fine of $75.00 per day plus administrative fees. Signed green card dated April 7, 2025. The property was last inspected on May 16, 2025, and the violation still exists.
