I. CALL TO ORDER
Hilary Zalman, Code Enforcement Special Magistrate, called the Hearings to order at
9:08 a.m., and explained the Magistrate's role and the procedures. Pursuant to Chapter
162, Florida Statutes, all orders are appealable only to the Circuit Court in Palm Beach
County and not to the City Commission. Also, a fine will be imposed if the violation(s) are
not corrected by the deadline.

Mr. Ham stated that Caroline has been deceased since 2019. He said that he was her
fiancé at the time of death and that he occupies the property from time to time. He
commented that there is no rental income and that he is only paying the property fees.

He said that the owner is in question and that he believes ownership is going to a niece
in London.
Magistrate Zalman requested clarification on the violations.
Pat Hart, Code Enforcement Supervisor, stated that according to Business Tax any
monies paid whether utilities or taxes could be considered a form of rental payment and
that a business license is required.
Magistrate Zalman agreed with Mr. Hart but stated that Mr. Ham was not the owner. She
explained to Mr. Ham that he can apply for a Business Tax Receipt and a Certificate of
Use of Occupancy because a non-owner is living there and paying fees. She said that if
he ever does become the owner, he would not have to get the permits.
Ms. Ortiz advised Mr. Ham to contact her for an inspection after he gets the permits.

Michael Dubose, the respondent, was present.
Magistrate Zalman reviewed the violations and requested status.
Mr. Dubose said that he is not happy with the Code Enforcement Department. He stated
that the tree is not falling but that he is intentionally leaned the tree that way. He
commented that it is his first amendment right to express himself and that he wants his
trees to lean over.
Magistrate Zalman explained that she cannot change the code. She said that she will
order a compliance date, but it is up to the respondent on what he wants to do.
Mr. Dubose commented that this is a waste of his time. He said that he wanted to tear
down the gate but has been held up with the City for 3 years. He stated that he should
not have to put money into correcting the violation when the City is the hold up.
Magistrate Zalman commented that he should correct the violations because of his
neighbors and their property value.
Mr. Dubose said that he removed the gate from the side of the deck.
Magistrate Zalman questioned if this would make the respondent compliance.
Ms. Ortiz explained that she was not sure and that she has to check with the Building
Department.
Mr. Dubose stated that it is unfair for the Code Officer not to know and that the concern
is not a safety issue.

Magistrate Zalman inquired about the status of painting.
Mr. Dubose said that he is waiting for the City and that he has to find out if the property
will be torn down. He mentioned that he requested to develop the street and turn the
homes into restaurants. He commented that he is not leaving the property to be eye sore
but that he is waiting on the City.
Candice Stone, Code Enforcement Director, commented that they received many
complaints about Mr. Dubose property and others on the street. She said that even though
the property is vacant owners should still maintain the upkeep so that it does not become
a nuisance.
Patrick Hart, Code Enforcement Supervisor, commented that many meetings have been
set up with Mr. Dubose but that he has never shown up.
Magistrate Zalman commented that Mr. Dubose should set up a meeting with the City to
discuss all of his concerns as she can only address the violation she has. She explained
that he should apply for an extension if more time is needed.

Vanessa stated that they do and that it was mostly a clarification issue. She said that they
will be removing the outside furniture and trimming the trees. She asked for clarification
on what needs to be trimmed.
Mr. Rivera commented that he will speak with Vanessa and explain to her the violations.
He said that he spoke with her mom and thoroughly explained everything in Spanish.

Gregory Hicks stated that he inherited the property stated and that he is in the process of
cleaning it up.
Magistrate Zalman questioned Mr. Hicks about the inoperable car.
Mr. Hicks commented that the car is operable and that he has the paperwork for it.
Mr. Rivera commented that the car was deemed inoperable because there were several
cars with the one in question that had not been moved in months.

Magistrate Zalman reviewed the violations and asked for clarification.
Mr. Rivera explained that the homeowners' hedges were obstructing drivers' visibility and
that the bushes must be under 36 inches.
Ms. Wyatt explained that the hedges were cut on May 7, 2025, and that she did not know
this was a second violation. She said she spoke with officer on October 14, 2025, and
was told that the hedges had to be lowered more. She stated that she was unaware she
had to contact code after correcting the violation. She said that with or without the hedges
you cannot see from the corner and that there have been many accidents and that she
does not believe her hedges are the problem.
Mr. Rivera stated that he would go out and clear the violation and advised Ms. Wyatt that
the hedges must be maintained under 36 inches.
Shanicka questioned the administrative fees and stated that she cannot pay $384.12.
She requested a fee waiver.
Magistrate Zalman explained that if the issue is not resolved within the first few months,
then there is nothing they can do about the fees now that the case has come to a hearing.
Ms. Wyatt stated that there is no verbiage in the violation that says she has to contact
code after correcting the violation and that it is confusing.

Mr. Rivera commented that no one contacted him until he went out to hang the door
hanger. He said that he spoke to Ms. Wyatt on the Ring camera and explained to her
what needed to be done. Mr. Rivera said that after that conversation the hedges were
only trimmed.
