A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
BEACH, FLORIDA, DESIGNATING THE PALM BEACH COUNTY
4 SUPERVISOR OF ELECTIONS AS THE CITY'S CANVASSING BOARD FOR
5 THE MARCH 2026 MUNICIPAL ELECTION; AND FOR ALL OTHER
PURPOSES.

8 WHEREAS, the Palm Beach County Supervisor of Elections requires that the City
9 Commission designate, by Resolution, a Canvassing Board for the City Municipal Elections; and
10 WHEREAS, designating the Palm Beach County Supervisor of Elections as the City's
11 Canvassing Board for Municipal Elections would remove redundancy of Officials attending to the
12 same election activities, such as the pre-election testing of tabulation equipment, and opening,
13 tabulation, duplication, and the canvassing of ballots, and is the preference of the Supervisor of
14 Elections; and
15 WHEREAS, the City Commission has determined that the responsibility to "canvass the
lo returns" is a ministerial and non-legislative function that can be delegated by the City Commission;
17 and
18 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
19 best interests of the city's citizens and residents to designate the Palm Beach County Supervisor
20 of Elections as the City's canvassing board for the March 2026 municipal election.

22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
23 BEACH, FLORIDA, THAT:
24 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
25 being true and correct and are hereby made a specific part of this Resolution upon adoption.
26 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
27 designate the Palm Beach County Supervisor of Elections as the City's canvassing board for the
28 March 2026 municipal election. The Canvassing Board will handle the canvassing of ballots for the
29 general municipal election and for runoff elections, if necessary.
30 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby
31 authorizes the Mayor to execute any ancillary documents as may be necessary to accomplish the
32 purpose of this Resolution.

33 SECTION 4. If any clause, section, or other part or application of this Resolution shall be
34 held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional
35 or invalid part or application shall be considered as eliminated and so not affect the validity of the
36 remaining portions or applications remaining in full force and effect.
37 SECTION 5. The City shall indemnify and hold harmless the members of the canvassing
38 board if either or both are the subject of litigation arising from their duties as canvassing board
39 members.
40 SECTION 6. This Resolution shall take effect in accordance with the law.
