R26-013 1 2 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF 3 BOYNTON BEACH, FLORIDA, APPROVING AMENDMENT NO. 1 TO 4 LETTER OF AGREEMENT AND CONTRACT FOR BICYCLE AND 5 PEDESTRIAN FOCUSED INITIATIVE WITH THE FLORIDA DEPARTMENT 6 OF TRANSPORTATION THROUGH A GRANT WITH THE UNIVERSITY 7 OF NORTH FLORIDA TRAINING AND SERVICES INSTITUTE, INC., 8 D/B/A INSTITUTE OF POLICE TECHNOLOGY AND MANAGEMENT; 9 AND FOR ALL OTHER PURPOSES. 10 11 WHEREAS, the Florida Department of Transportation ("FDOT"), through a grant with the 12 University of North Florida Training and Services Institute, Inc. d/b/a Institute of Police 13 Technology and Management ("IPTM"), Project # 433144-1-8404, Contract # G3E95, uses law 14 enforcement support to reinforce safe pedestrian, bicyclist, and driver behaviors in priority 15 counties in Florida; and 16 WHEREAS, on August 5, 2025, the City Commission approved Resolution No. R25-199 17 approving the Letter of Agreement and Contract with the University of North Florida Training 18 and Services Institute, Inc., d/b/a Institute of Police Technology and Management for Pedestrian 19 and Bicycle Safety High Visibility Enforcement and Support Program in the amount of $5,389.98; 20 and 21 WHEREAS, FDOT and IPTM seek to amend the Letter of Agreement and Contract as they 22 have approved an additional $10,000 towards enforcement efforts, for a total amount of 23 $15,389.98; and 24 WHEREAS, approval of the amendment will allow BBPD to conduct education and 25 enforcement operations in areas specified as high-frequency crash fatality locations for 26 pedestrians and bicyclists; and 27 WHEREAS, the City Commission of the City of Boynton Beach, Florida, deems it to be in 28 the best interests of the citizens and residents of the City of Boynton Beach to approve 29 Amendment No. 1 to the Letter of Agreement and Contract. 30 31 32 RESOLUTION NO. R26-013 33 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 34 BEACH, FLORIDA, THAT: 35 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 36 being true and correct and are hereby made a specific part of this Resolution upon adoption 37 hereof. 38 SECTION 2. The City Commission hereby approves the Amendment No. 1 to the Letter 39 of Agreement and Contract, to reduce traffic crashes resulting in serious and fatal injuries to 40 pedestrians and bicyclists using high visibility education and enforcement details by increasing 41 the total agreement amount to $15,389.98, in form and substance similar to that attached as 42 "Exhibit A" and authorizes the Mayor to execute the Amendment. 43 SECTION 3. The Mayor-executed Amendment shall be forwarded to Jaclyn Smith to 44 obtain full execution of the Amendment. Jaclyn Smith shall be responsible for ensuring that one 45 fully executed Amendment is returned to the City, to be provided to the Office of the City 46 Attorney for forwarding to the City Clerk for retention as a public record. 47 SECTION 4. WHEREAS, "IPTM" and "Vendor" agree to the following Amendment to the Original Agreement, such Amendment to be effective once the last party has signed the amendment. The amendment is to increase the contract by$10,000.00 for a new total of$15,389.98. This increase will allow the agency to continue High Visibility Enforcement (HVE) operations from January 2026 through May 8, 2026.
