Affordable Housing Advisory Committee
MEMBERSHIP QUALIFICATIONS/REQUIREMENTS. Members serving on advisory boards
or Committees shall possess sufficient knowledge.experience judgment or background
necessary to competently serve the Board or Committee to which they are appointed.
Members shall be residents of or own property in the City own a business within the City.or
be an officer Director or manager of a business located within the City except as may be
provided for by Florida Statutes, Special Act or Resolution of the City Commission or
elsewhere within the Code of Ordinances of the City of Delray Beach.The Planning and
Zoning Board will nominate one of their members at a meeting that will later be ratified by
the Commission.
In addition, Florida Statute 420.9076 requires that the committee consist of one locally elected
official and one representative from 6 of the following categories:
(a) A citizen who is actively engaged in the residential home building industry in connection
with affordable housing.
(b) A citizen who is actively engaged in the banking or mortgage banking industry in
connection with affordable housing.
(c) A citizen who is a representative of those areas of labor actively engaged in home
building in connection with affordable housing.
(d) A citizen who is actively engaged as an advocate for low-income persons in connection
with affordable housing.
(e) A citizen who is actively engaged as a for-profit provider of affordable housing
(f) A citizen who is actively engaged as a not-for-profit provider of affordable housing.
(g) A citizen who is actively engaged as a real estate professional in connection with
affordable housing
(h) A citizen who actively serves on the local planning agency pursuant to s 163.3174. If the
local planning agency is comprised of the governing board of the county or municipality,the
governing board may appoint a designee who is knowledgeable in the local planning process.
(i) A citizen who resides within the jurisdiction of the local governing body making the
appointments
(j) A citizen who represents employers within the jurisdiction
(k) A citizen who represents essential services personnel, as defined in the local housing
assistance plan.
PURPOSE: is to provide recommendation of incentives for affordable housing to the City
Commission
1. SCHEDULE: Unless approved by the City Manager or the City Manager's Designee and
otherwise advertised, regular meetings of the Committee will take place a minimum of three
times a year on the second Thursday of the month at 6.00 p.m. If the meeting is adjourned.
any unfinished business shall be considered at the next regular meeting or at a time and
place set by the Committee
2.WORKSHOPS AND SPECIAL MEETINGS. Committee Members will be required to attend
an Annual Training Workshop.Otherwise.Workshops or Special Meetings may only be
scheduled at the discretion of the Commission,City Manager.or the City Manager's
Designee.
3.QUORUM:A quorum is required to conduct a meeting.A quorum shall consist of six
members. If no quorum exists within fifteen(15)minutes after the designated meeting time or
if a quorum is lost the meeting shall be adjourned The names of the members present and
the time of adjournment shall be recorded in the minutes by the Committee Clerk
4. PUBLIC MEETINGS-All meetings shall be open to the public
5.AGENDA-The Staff Liaison shall prepare the Agenda and make every effort to deliver a
complete agenda to the Committee no later than 5:00 p.m five business days before the
regular meeting. The agenda.as well as lengthy reports and standard documents that are
part of the agenda's back-up documentation.shall be available for review by the public. Items
will be addressed individually in the order presented on the Agenda, unless reordered upon
approval by a majority of the Committee.An item may be added to a subsequent agenda if a
majority of the Committee so directs,either by consensus or by vote of the Committee.
6.COMPLIANCE WITH CODE OF ETHICS:Committee Members shall comply with the rules
as described in Sections 2-44 Ito 2-448 of the Palm Beach County Code of Ethics and the
State of Florida Code of Ethics,codified in Part III of Chapter 112 of the Florida Statutes.
Board of Adjustment
(A)PURPOSE:The Board of Adjustment for the City of Delray Beach has been created under
the authority of Section 3.14 of the City Charter.
(B)COMPOSITION:The Board of Adjustment shall consist of seven regular members.
(1)At least four seats on the Board must be filled with either a land use attorney.architect.
landscape architect, realtor/real estate broker,civil engineer. general contractor, land planner.
building inspector,fire safety professional or other design professional who is familiar with the
Florida Building Code
(2)The remaining three seats may be at large.
(3)The appointing body shall endeavor to appoint as many disciplines as possible to the
Board. If there is a lack of applicants to fill the seats reserved for professionals at large
members may be considered.
(C)QUORUM: Five members of the Board shall constitute a quorum
(D)ACTIONS:
(1)A motion to approve a variance requires at least five votes to pass the motion
(2)A motion to approve a request to reverse a decision of the Chief Building Official requires
at least five votes to pass.
(3)If a tie vote results from a motion.then the matter considered will be deemed to have been
denied.
(E)DUTIES, POWERS AND RESPONSIBILITIES:
(1)BOARD ACTION:The Board of Adjustment has the authority to take action on the
following items pursuant to the procedures and standards of the LDR:
(a)Decide appeals where it is alleged there is an error in any order,requirement.decision. or
determination made by the Chief Building Official.
1. Such appeals do not include interpretations of use matters and other items specifically
preempted or granted to others pursuant to the LDR.
2 So long as its actions are in conformity with the LDR the Board may reverse or affirm.
wholly or partly,or may modify the order,requirement,or decision.or determination under
appeal. and to that end shall have the same powers of the Chief Building Official.
(b)The Board has the authority to take action on duly filed appeals of an interpretation:
administrative decision,or enforcement action by the Chief Building Official related to the
following regulations:
1. Building Code,Article 7.1. except Sections 7.1 5 through 7.1 7
2. Electrical Code,Article 7.2
3.Gas Code,Article 7 3
4. Housing Code.Article 7.4
5. Mechanical Code,Article 7.5
6. Plumbing Code,Article 7.6;
7. Unsafe Buildings or Structures,Article 7.8.
8. Moving of Building Article 7.10
(c)The Board hereby has the authority to grant variances and hear appeals from the
following:
1. Base district development standards, Section 4.3 4. for single-family or duplex uses, unless
otherwise stated
2. Flood Damage Control Districts and Coastal Construction, Chapter 10,for single-family or
duplex uses.
3. Supplemental District Regulations.Article 4.6.for single-family or duplex uses, unless
otherwise stated except where said authority is expressly prohibited. granted to others, or
relief is available through another process.
4. Docks, Dolphins, Finger Piers. and Boat Lifts,Article 7 9, for single-family or duplex
structures.
5. Fire Prevention Codes Chapter 96 of The City Code of Ordinances, per Section 96.06.
6. Section I "District Regulations and Incentives,"of the Beach Property Owners Design
Manual for the North Beach and Seagate Neighborhoods as set forth in Section 4.5.13.
City Commission
CITY COMMISSION COMPOSITION ELIGIBILITY,ELECTION.AND TERMS
Composition and Term.The City Commission shall be composed of five(5)Commissioners,
one of whom shall be duly elected Mayor All of them shall be elected at large for a term of
three(3)years in the manner provided in this Charter.
QUALIFICATIONS OF CANDIDATES ELECTION.
(A)Regulation of Qualifications The qualifications,time,manner,and costs of qualifying as a
candidate for Mayor or Commissioner shall be regulated by Chapter 34 of the Code of
Ordinances of the City.
(B)Filing of Candidate Petitions All candidate petitions shall be filed with the City Clerk in
accordance with the requirements of Chapter 34 of the Code of Ordinances of the City.
however,if a special election to fill a vacancy in the office of Mayor is to be held.the time for
qualifying shall be as provided by this Charter and Chapter 34 of the Code of Ordinances of
the City of Delray Beach
(C)Names of Candidates The City Clerk shall deliver the names of all candidates and the
offices for which they have filed.to the Supervisor of Elections no later than 5:00 p.m on the
first Friday after the close of qualifying
MAYOR,VICE-MAYOR.AND DEPUTY VICE-MAYOR
(A)DUTIES OF THE MAYOR The Mayor shall preside at meetings of the Commission and
represent the City in intergovernmental relationships The Mayor shall be recognized as the
head of the City government for all ceremonial purposes.service of process and by the
Governor for purposes of military law.The Mayor shall execute contracts,deeds,
intergovernmental agreements and certifications.and other documents on behalf of the City,
but shall have no administrative duties except as required to carry out the foregoing
responsibilities
(B)DUTIES OF THE VICE-MAYOR In the absence or disability of the Mayor the Vice-Mayor
shall serve as Mayor,possessing all the powers,duties.and prerogatives of the Mayor.
(C)DUTIES OF THE DEPUTY VICE-MAYOR:While the Vice-Mayor is serving as Mayor,or in
the absence or disability of the Vice-Mayor,or should the Vice-Mayor refuse to perform the
duties imposed by law.the Deputy Vice-Mayor shall have all the powers duties,and
prerogatives of the Vice-Mayor.
(D)NO VETO POWER.The Mayor.Vice-Mayor and Deputy Vice-Mayor shall each have a
voice and a vote in the proceedings of the Commission but no veto power
TERM LIMITS
(A)TERM LIMIT Individual Commissioners. including the Mayor.shall be prohibited from
holding office for more than six(6)consecutive years. However. in the event a Commissioner
assumes the office of Mayor the time that the Commissioner held office as a Commissioner
shall not count toward the maximum time allowed to hold the office of Mayor The person
assuming the office of Mayor will be allowed to hold office for a maximum of six consecutive
years This shall apply to any Commissioner who has assumed the office of Mayor on or after
the March 2013 municipal election. This extension of term limits does not apply in the case of
the Mayor assuming the office of a Commissioner The term"holding office"shall be defined
as serving as Commissioner or Mayor.The term"consecutive years"shall not include any
years served as a result of an appointment. Effective for those elected in March of the year
2003 and thereafter,a Commissioner or Mayor may complete the entire term to which they
were elected,if a term limit is reached during an elected term
(B)ONE YEAR HIATUS A person who has served the maximum amount of consecutive time
allowed by this Charter as a Commissioner or Mayor shall not assume office again until the
last Thursday in March of the year following the expiration of his or her term of office
PROCEDURE.
(A)MEETINGS:The Commission shall meet regularly at least twice a month at times and
places that the Commission prescribes by rule or otherwise. Special meetings may be held on
the call of the Mayor or of a majority of the commission.Whenever practicable,there shall be
at least twelve(12)hours'notice of a special meeting to individual members of the
Commission and to the public.
(B)RULES:The commission shall determine its own rules and order of business
(C)QUORUM AND VOTING.
(1)A quorum for the transaction of business shall consist of three(3)members, but a smaller
number may adjourn from time to time and may compel the attendance of absent members in
the manner and subject to the penalties prescribed by the Rules of the Commission
(2)Voting on ordinances: resolutions,and motions shall be as set forth below and shall be
recorded in the minutes.
(3)Except as otherwise provided in the Charter. no action of the Commission shall be valid or
binding unless adopted by the affirmative votes of at least three(3)members of the
Commission. and,if any motion fails to achieve the affirmative vote of at least three(3)
members of the Commission,then such motion shall be deemed to have failed and no action
shall be taken by that motion. In the event that there are less than three(3)members of the
Commission who are eligible to vote on a particular matter due to vacancy or required
abstention pursuant to applicable state or county law,then the remaining member(s)of the
Commission may vote and approve such matter by unanimous vote.

Code Enforcement Board
COMPOSITION,APPOINTMENT OF MEMBERS:
The Code Enforcement Board shall be composed of seven(7)regular members.along with
two(2)alternate members.appointed by the City Commission.Appointments to both regular
and alternate member positions shall be on the basis of experience or interest in the fields of
zoning and building control The regular and alternate membership of the Board shall
whenever possible.include an architect a business person.an engineer.a general
contractor,a subcontractor and a Realtor
QUALIFICATIONS OF MEMBERS
Each regular member and alternate member appointed to the Code Enforcement Board shall
possess,in addition to experience or interest in the fields of zoning and building control.the
following minimum qualifications.where appropriate:
(A)The architect and the engineer shall be registered under the laws of the State regulating
the practice of architecture and engineering.or shall possess similar qualifications under the
laws of other states,or shall have actual experience deemed by the City Commission to be
equivalent to such registration
(B)The general contractor and the subcontractor shall possess a valid certificate of
competency and business tax receipt recognized and accepted under the laws of the State
and the ordinances of the City regulating the business of contracting.and where required.
Slate registration as a contractor,or shall possess similar qualifications under the laws of
other states.or shall have actual experience deemed by the Commission to be equivalent to a
certification.
(C)The Realtor shall be licensed under the laws of the State licensing real estate brokers as
either a broker or a salesperson.or shall possess similar qualifications under the laws of other
states,or shall have actual experience deemed by the Commission to be equivalent to
licensing.
(D)The businessperson shall be actively engaged in any lawful business within the City and
shall hold a current and valid business tax receipt issued by the City.or shall be an officer or
employee of a business entity holding a current and valid business tax receipt issued by the
City or shall have actual experience deemed by the Commission to be equivalent to a
certification
(E)Each regular and alternate member of the Code Enforcement Board shall be a resident of
the City.
To hear alleged municipal code violations and to render a decision.The Code Enforcement
Board is a quasi-judicial body created in accordance with Florida State law
Delray Beach Downtown Development Authority
PURPOSE:To make recommendations to the City Commission for improving the
attractiveness and efficient use of the downtown area.and to facilitate activities that will
benefit the businesses
MEMBERSHIP 7
TERM:3 years
QUALIFICATIONS.All members must reside in or have a principal place of business in the
city.At least four members shall own land in the downtown area,pay taxes on a leased
property.or serve as a director officer or managing agent to an owner or lessee who is
required to pay taxes City officials and city employees are not eligible for membership
MEETINGS:The second Monday of each month at 12:00 noon in the Commission Chambers,
City Hall
Delray Beach Housing Authority
PURPOSE:To provide decent,safe,sanitary and affordable housing to persons of low-
income The Delray Beach Housing Authority is a non-profit corporation created in
accordance with Florida State Law
MEMBERSHIP Seven
TERM:Four years
QUALIFICATIONS:Residency is not a requirement to serve as a commissioner however.one
member must be a resident current in rent.of the housing project or a person of low or very
low income who resides within the housing authority's jurisdiction and is receiving rent
subsidy through a program administered by the authority.City officials and city employees are
not eligible for membership
MEETINGS-The third Thursday of each month at 4:00 p.m.at 82 NW 5th Avenue,Delray
Beach
Firefighters Retirement System Board of Trustees
PURPOSE.The purpose of the Board is to continue providing retirement benefits to City
Firefighters'and their beneficiaries,as provided in Section 33.74 and 33.78(B).
MEMBERSHIP Five regular
TERM:Four years
QUALIFICATIONS:All members must be either a resident of the City of Delray Beach In
accordance with Ordinance 18-24 of the City Code,the City Commission appoints two(2)
public members to the Board of Trustees
General Employees Retirement Fund Committee
PURPOSE:To administer the pension plan for all general city employees This entails
approval of pension benefits plan expenses and oversight in the investment of plan assets.
MEMBERSHIP Five
TERM:2 Years
QUALIFICATIONS:Members may but need not.be an official or employee of the city.
tvIEETINGS Quarterly on the third Thursday of the following month at 1:00 p m.in the First
Floor Conference Room,City Hall.
Green Implementation Advancement Board
PURPOSE:To make recommendations regarding ways to improve the environmental
sustainability of City programs.services.equipment and facilities.strategies for improving the
environmental sustainability of the community;incentives for residents,businesses.and
organizations to practice environmental conservation including recycling;proposed means to
enhance water and energy conservation ideas for promotion of tree planting and xeriscaping:
best practices to be considered for implementation in Delray Beach.
MEMBERSHIP:Five
TERM Two years
QUALIFICATIONS'All members shall have expertise or an interest in environmental
conservation and sustainability and must be either a resident of,own property.own a
business or be an officer,director or manager of a business located within the City of Delray
Beach.
MEETINGS The third Thursday of each month at 900 a m at the Swinton Operations
Complex
Historic Preservation Board
PURPOSE:The purpose of the Historic Preservation Board is to foster and promote the
recognition,protection.enhancement.and use of historic resources in the City of Delray
Beach The Board,through the City's Histonc Preservation Division of Development Services,
shall also promote certain functional and aesthetic goals objectives and policies as set forth
in the City's Comprehensive Plan.particularly the Historic Preservation Element.as they
relate to the preservation of Delray Beach's historic resources The Historic Preservation
Board reviews all matters pertaining to Certificate of Appropriateness requests for property.
sites,and structures located within a Historic District or for Individually Designated Sites as
listed on the Local Register of Historic Places in Section 4 5 1(1)
MEMBERSHIP Seven
TERM:Two years
QUALIFICATIONS
(1)At least five seats on the Board must be filled with either an architect.landscape architect
civil engineer general contractor,historian,preservationist,land planner.archaeologist,
cultural anthropologist museum curator or conservationist.

• (2)The remaining two seats shall be at large Lay persons with knowledge,experience and
judgment who have an interest in historic preservation shall make up the balance of the
Board.
(3)The appointing body shall endeavor to appoint as many of the required disciplines as
possible to the Board to ensure compliance with the requirements of the City's designation as
a Certified Local Government by the State of Florida
(4)Preference should be given to professional and lay persons who own property within
historic districts or whose property is individually listed in the Local Register of Historic Places
MEETINGS The first and third Wednesday of each month at 6-00 p.m in the City
Commission Chambers,City Hall.
Opioid Settlement Advisory Committee
PURPOSE'
The OSAC shall meet to review the needs of the community and recommend to the City
Commission how to expend Opioid Litigation Settlement Funds.
MEETINGS
Meetings will be held on an as needed basis All meetings of the OSAC are public meetings
subject to the provisions of Chapter 286, Florida Statutes,also known as the"Florida
Sunshine Law."
BOARD MEMBERSHIP AND QUALIFICATIONS'
The following members shall meet the following qualifications
i One(1)member representing the City of Delray Beach Police Department.
ii One(1)member representing the City of Delray Beach Fire Department
iii One(1)member who is a State of Florida Licensed Mental Health Professional

v.One(1)member who is a State of Florida Certified Addiction Professional,Certified
Addiction Counselor,or Certified Recovery Peer Specialist (VACANCY)
vi Two(2)at-large members who are residents of the City of Delray Beach

Parking Management Advisory Board
PURPOSE:Formal advisory board tasked with advising and making recommendations to the
City Commission with respect to parking management policy and issues related to planning.
financing development.construction and operation of parking families within the City of

QUALIFICATIONS All citizen-at-large representatives shall have expertise or interest in
parking management policy and related issues and shall be residents of or own property in
the City,own a business with the City.or be an office director or manager of a business
located within the City

MEETINGS Fourth Tuesdays of every month at 5 30 p m.at the Swinton Operations
Complex
Planning and Zoning Board
PURPOSE:The Planning and Zoning Board for the City of Delray Beach has been created
under the authority of Section 3.14 of the City Charter and is designated as the Local
Planning Agency under the Florida Community Planning Act.Section 166 3164 et seq
Florida Statutes.for the City of Delray Beach
COMPOSITION and QUALIFICATIONS The Planning and Zoning Board shall consist of
seven members.
(1)At least five seats on the Board must be filled with either an architect.landscape architect
reattor!real estate broker.civil engineer.developer general contractor.land planner or land
use attorney
(2)The remaining two seats shall be at large

Police Advisory Board
PURPOSE The Police Advisory Board acts as an advisory body to the Chief of Police,City
Manager and City Commission on policy and resource issues.serves as a conduit for the
community to address their issues and community problems through a cooperative effort;
reviews community needs concerns expectations and responses relative to police services
and community policing.and advises the Police Department on and provides support for
communication and education between the community and the Police Department
COMPOSITION,APPOINTMENT.TERMS
The Police Advisory Board shall be composed of five(5)regular members All board members
appointed by the City Commission shall be subject to the provisions of Sections 32 06 to
32.18 of this Code.
QUALIFICATIONS OF MEMBERS
(A)The Police Advisory Board membership shall include a diverse cross-section of the
community.
(B)The membership shall include business owners,religious and faith-based organizations.
youth,school officials and local organizations where feasible
(C)The City Commission shall endeavor to include as many racial and ethnic minority
members as possible.
MEETINGS:
(A)The Police Advisory Board shall meet at least once quarterly on the second Monday in the
quarter except when that date falls on a holiday In that circumstance,the Board shall
establish another regular meeting date for that quarter.The Police Advisory Board may hold
special meetings at the direction of its chairperson upon twenty-four(24)hours'notice.
Police Officers'Retirement System Board of Trustees
PURPOSE:The purpose of the Board is to continue providing retirement benefits to City
Police Officers'and their beneficianes.as provided in Section 33.60 and 33 64(B)
MEMBERSHIP Five regular
TERM:Four years.
QUALIFICATIONS All members must be either a resident of the City of Delray Beach.In
accordance with Ordinance 17 16 of the City Code the City Commission appoints two(2)
public members to the Board of Trustees
Public Art Advisory Board
PURPOSE:The Public Art Advisory Board was established via Ordinance No. 77-04 for the
purpose of advising and making recommendations to the City Commission with respect to
public art policy and related issues including,but not limited to.the selection.construction.
placement and/or funding of public art in or on City right-of-way,City owned property or
private property where an agreement acceptable to the City.has been executed regarding the
art and the art is clearly visible by the public.
COMPOSITION AND QUALIFICATIONS:The Public Art Advisory Board shall consist of seven
members(1)At least three seats on the Board must be filled with either an artist architect..
landscape architect or engineer.(2)The remaining four seats shall be at large and consist of

Site Plan Review and Appearance Board
PURPOSE:The purpose of the Site Plan Review and Appearance Board(SPRAB)is to
promote certain functional and aesthetic goals,objectives. and policies as set forth in the

COMPOSITION:The SPRAB shall consist of seven members.(1)At least rive seats on the
Board must be filled with either an architect. landscape architect land use attorney,
reactor/real estate broker civil engineer,general contractor land planner or interior designer
(2)The remaining two seats shall be at large.(3)The appointing body shall endeavor to appoint
as many of the required disciplines as possible to the Board.
