Mr. Kutzman stated that the survey he was provided with does show a fence, but it is not the wood fence in question. He said that he would not accept the survey. Mr. Izard stated that Mr. Kutzman's findings are incorrect. He said that the survey lists the wood fence and that the affidavit states that the wood fence is not on their property line. Magistrate Zalman reviewed the survey and affidavit. Mr. Izard stated that he has emails from the Aldi's located next to his property and that they discussed replacing the wood fence. He said that the fence was built by the Stonehaven Community which is located next to Aldi's and to his property. He mentioned that he did not believe they would want him to remove the fence. Candice Stone, Code Enforcement Director, stated that this case has been tabled and reviewed multiple times. 21 Mr. Izard said that at the last hearing, he was instructed to provide the documents showing that the fence was not on his property, which he had provided. She explained that her father lives on the property but that she does not collect any rent. She said that her father has had a major stroke and that she has taken out a loan to make the home can be handicap accessible for her father. She explained that there is about $40k being held in escrow until the lien is resolved. Magistrate Zalman inquired about the value of the home. Ms. Marcellus stated that she believed the value to be about $260k. Magistrate Zalman pointed out that the property is not homestead and asked Ms. Marcellus to make a counteroffer. Candice Stone, Code Enforcement Director, stated that the trees on the property were to be trimmed but that the landscaper chopped them down. She stated this created another violation.
