I. CALL TO ORDER
Hilary Zalman, Code Enforcement Special Magistrate, called the Hearings to order at
9:11 a.m., and explained the Magistrate's role and the procedures. Pursuant to Chapter
162, Florida Statutes, all orders are appealable only to the Circuit Court in Palm Beach
County and not to the City Commission. Also, a fine will be imposed if the violation(s) are
not corrected by the deadline.

based business.
Magistrate Zalman questioned if Mr. Kesner runs a business from the property.
Mr. Kesner stated that he does not run a business from the property and that someone
else completed the application.
Mr. Chevalier-Bien Aime stated that the application does not include Mr. Kesner's name
and provided Magistrate Zalman with a copy of the application.
Magistrate Zalman asked Mr. Kesner if he was aware of a business by the name of Jerry
Superior Painting.
Mr. Kesner stated that that is his roommate's business and that he was not aware of the
application.
Magistrate Zalman reviewed the other violation and advised the respondent that he needs
to add sod.
Mr. Kesner said that he wanted to put bricks in the area because he doesn't believe the
sod will last.
Mr. Chevalier-Bien Aime said that Mr. Kesner would need a permit if he wishes to add
bricks or pavers.
Magistrate Zalman inquired if Mr. Kesner would be able to clear up the violations by the
recommended date of the City.
Mr. Kesner said that he will begin to clear up the violations.

rental application. He commented that the short-term rental application will not get
approved until the permit for the fence is complete.
Magistrate Zalman asked Mr. Mase how much time does he need to clear up the
violations.
Mr. Mase said that the short-term rental application is pending, and hopefully it will be
approved within a week. He said that he would still have to take care of the fence.
Magistrate Zalman inquired if the City had an objection to providing Mr. Mase with more
time.
Ms. Ortiz said that there is no objection.

Mr. Grant stated that his clients spent 7k on the air conditioner and 3k correcting the
other violations. He proposed an offer of 5k plus the administrative cost.
