O91-46 ORDINANCE NO. O91-A~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REZONING A CERTAIN PARCEL OF LAND WITHIN THE CITY OF BOYNTON BEACH, FLORIDA FROM C-2 (NEIGHBORHOOD COMMERCIAL) TO C-3 (COMAgJNITY COMMERCIAL), LIMITED TO 2-STORY BUILDINGS; PROVIDING FOR APPROPRIATE NOTATIONS ON THE OFFICIAL ZONING MAP; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AUTHORITY TO CODIFY; AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, ?lorida, has adopted a Comprehensive Plan by Ordinance 89-38 in ~ccordance with Chapter 163, Florida Statutes; and WHEREAS, Christopher Cutro, Planning Director of this City, ~as heretofore filed a Petition with the City of Boynton Beach, 'lorida, pursuant to Section 9 of Appendix A - Zoning, of the lode of Ordinances, City of Boynton Beach, Florida, for the ~urpose of implementing the recommendations in Planning Area 1.i ~f the Land Use Problems and Opportunities Section of the 1989 2ity of Boynton Beach Comprehensive Plan by rezoning a certain ~arcel of land within the municipal limits of said City, said from C-2 ~roperty being more particularly described hereinafter, (Neighborhood Commercial) to C-3 (Community to 2-story buildings; and WHEREAS, after public hearing and consideration of the recommendation of the Zoning Board, the City Commission deems it Commercial) limited study, and after City's Planning and to be in the best Lnterest of the inhabitants of said City to rezone the property. Railway, in Section 22, Range 43, Township 45, and The south 534.8 feet of Government Lot ~2 laying west of F.E.C. Railway, in Section 22, Range 43, Township 45, and The north 75 feet of Government Lot #3 laying west of F.E.C. Railway (less C-16 Canal R/W), in Section 22, Range 43, Township 45. Containing 2.44 acres more or less, and subject to easements and rights of way record. De and the same is hereby rezoned from C-2 (Neighborhood ommercial) to C-3 (Community Commercial), limited to -story buildings. Section 2. The City administration shall make an ~ppropriate notation on the City's Official Zoning Map indicating the rezoning, pending the adoption of a revised ~fficial Zoning Map. Section 3. That all ordinances or parts of ordinances n conflict herewith be and the same are hereby repealed. ~Section 4.
