09-05-58ARESOLUTION WHEREAS, the City Council of the City of Boynton Beach, Palm Beach County, Florida, is gravely concerned over the health, safety and welfare of its citizens, and, WHEREAS, it has been brought to the attention of the City Council of the City of Boynton t~.each, l~alnu Beach County, Florida, that certain convict road gangs con, posed of prisoners of the State of Florida, are working on the highways and roadways of the State of Florida within the limits of the County of Palm Beach, and within the limits of the City of Boynton Beach, without having adequate armed guards, and, WHEREAS, it has been brought to the attention of the City Council of the City of Boynton Beach, Florida, that convicts have escaped the said road gangs by reason, or because of the lack of the guards being armed with firearms and the said prisoners have been, and are a threat to the health, safety and welfare of the citizens of Boynton Beach, and Palr~_ Beach County, and State of Florida, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: 1. That the said Road Department of the State of Florida, and those in charge of the prisoners working within the County of Paha-~ Beach, Florida, and the City of Eoynton ~each, Florida, be prohibited from per- mitting any prison road gang crews from being outside of confinement unless adequate guards are present, and said guards are armed with sufficie~_t and proper firearms to prevent the escape of said road gang prisoners, as it is determined that such prisoners, when not under armed guard are a potention threat to the health, safety a~d welfare of the citizens of Eoynton t~each, County of Palm Eeach, and of the State of Florida. 2. That the order now in effect which permits the prisoners to be at large and outside of confinement without being under the supervision of guards armed with adequate firearms to prevent the escape of said prisoners be immediately rescinded a~d that guards be im~ediately supplied with firearms and ammu~.ition sufficiently to guard said priso~ers while being transported or being worked on the highways, or elsewhere while outside of confinen~ent and within the County of Palm ~each, City of F- oynton ~each or State of Florida 3. That by reason of the escape of two (2) prisoners on Septembe~ 3, 1958, and the escape of one (1) prisoner on September 4, 1958, within the County of Paln~ ~each and State of Florida, that the said escaped prisoners or sonae of them were seen within the city limits of the City of t~o~:ton ~.each, Palm t~each County, Florida, and said prisoners are a threat to the peace, health, safety and welfare of the citizens of t~oyr, ton t~..each, and Palm t~each County and State of Florida. That such escape was while the guards supervising the work were not armed and that the said guard~ not having been armed did afford the escape of such prisoners. 4. That a copy of this said F;esolution be sent to the Governor of the State of Florida, ~ionorable LeFoy Col;~ins; Honorable Joe Grotegut, Chairman of the State Foad Depart~,ent of the State of Florida.
