AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 21 SIGNS., SECTION 21-3.
DEFINITIONS, AMENDING THE DEFINITION OF BUS
BENCH SIGN, AND PROVIDING A DEFINITION FOR
BUS SHELTER SIGN; AMENDING SECTION 21-17.
EXEMPTIONS; AMENDING SECTION 21-31. SPECIAL
SIGNS TO PROVIDE FOR BUS SHELTER SIGNS;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach, Florida,
upon recommendation of staff as well as the Planning and Development Board,
deem it to be in the best interests of the citizens and residents of the City of
Boynton Beach to amend Section 21 of the Code of Ordinances of the City of
Boynton Beach; and
WHEREAS, the City Commission of the City of Boynton Beach, Florida has
determined that the proposed amendment to the Sign Code is consistent with the
comprehensive plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. . That Section 21-3. Definitions. of the Code of Ordinances of the
City of Boynton Beach, Florida is hereby amended by adding the words and figures
in underlined type and by deleting the words and figures in struck-through type, as
follows:
Sec.21-3. Definitions
Bus bench sign: A bench, or o,- shelve,- seat, with
graphics, symbols and/or copy affixed against any
surface.
Bus shelter sign: GraPhics, symbols and/or copy
affixed to any surface of a public transit shelter,
Section 2. That Section 21-17. Exemptions. of the Code of Ordinances of
the City of Boynton Beach, Florida is hereby amended by adding the words and
figures in underlined type and by deleting the words and figures in struck-through
type, as follows:
Sec. 21-17. Exemptions.
(I) Bus shelter signs
Section 3. That Section 21-31. Special signs, of the Code of Ordinances of
the City of Boynton Beach, Florida is hereby amended by adding the words and
figures in underlined type and by deleting the words and figures in struck-through
type, as follows:
(e) Bus shelter signs.
Signs on City transit stop shelters may be permitted
when authorized by written agreement approved by
action of the City Commission pursuant to the provisions
of Section 337.407(.2). F.S. when so authorized, the
following standards shall apply:
1. Signs on City_ transit stop shelters shall be
permitted only on shelters at City transit stops
designated by the City. Placement of bus shelters
shall be subject to City review so that no shelter
shall be permitted to obstruct a public sidewalk or
create a hazard or to otherwise be detrimental to the
public safety_. A permit for each bus shelter shall be
required, but no permit fee shall be charged.
2. Bus shelters shall be designed to meet City
building code requirements.
3. Any bus shelter located on a sidewalk within a
public right-of-way, shall be so located so as to leave
at least 36 inches clearance for pedestrians and
persons in wheelchairs. Such clearance shall be
measured in a direction perpendicular to the
centerline of the road. in addition, shelters and pads
shall comply with the Americans with Disabilities Act
Implementation Manual, Accessibility Guidelines for
Transportation Facilities; Part IV of the Federal
Register, Transportation for Individuals with
Disabilities; Florida Statutes, Section 337; the Florida
Administrative Code Rule Chapter 14-20 and any City
standards or guidelines for placement alld design.
4. Not more than one bus shelter displaying
signage or intended for the display of signage shall
be permitted at a City transit stop.
5, Display space on bus shelters shall be limited
in location and size to the side or rear wind screen
panels. If any bus shelter signage is deemed
ob!ectionable in the judgment of the. City_, it shall be
removed by the sponsoring organization.
6. Should any bus shelter or bus shelter sign fail
to conform to the above standards; or should a
property_ owner ob!eot to the presence of a bus
shelter abutting his property, then the City. may order
the sponsoring organization to remove such bus
shelter and, that failing, may remove same at the
expense of the sponsoring organization.
Section 4. Each and every other provision of Section 21. not hereinbefore
specifically amended shall remain in full force and effect.
Section 5. Should any section or provision of this Ordinance of any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision
shall not affect the remainder of this Ordinance.
Section 6. Authority is hereby given to codify this Ordinance.
Section 7. EFFECTIVE DATE, This Ordinance shall become effective
immediately upon passage.
