AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA
AMENDING CHAPTER 23, OF THE LAND
DEVELOPMENT REGULATIONS, "PARKING LOTS",
BY AMENDING ARTICLE II. "REQUIRED
IMPROVEMENTS", BY AMENDING PARAGRAPH
"F" TO PERMIT DRAINAGE STRUCTURES AND
FRENCH DRAINS TO BE CONSTRUCTED UNDER
STANDARDS OF THE SOUTH FLORIDA WATER
MANAGEMENT DISTRICT; BY AMENDING
PARAGRAPH H.7 TO PROVIDE AN EXCEPTION
PERMITTING MORE THAN TWO (2) DRIVEWAYS
ALONG THE WEST SIDE OF NE 6TM STREET
NORTH OF OCEAN AVENUE; PROVIDING FOR
CONFLICTS, SEVERABILITY, CODIFICATION AND
AN EFFECTIVE DATE.
WHEREAS, it has come to the attention of the City Commission of the
City of Boynton Beach that amendments are required regarding certain Sections
and Articles in the City's Land Development Regulations; and
WHEREAS, upon recommendation of staff, the City Commission of the
City of Boynton Beach has deemed it to be in the best interests of the citizens
and residents of the City of Boynton Beach to amend Article II, Section F of
Chapter 23 of these Land Development Regulations by permitting drainage
structures and french drains to be constructed in compliance with city standards
or standards of the South Florida Water Management District; and
WHEREAS, the City Commission has determined that due to the unique
nature of the area along the west side of NE 6th Street north of Ocean Avenue, it
is in the best interests of the citizens and residents of the City of Boynton Beach

to permit more than two (2) driveways to a property.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Chapter 23, Article II. "Required Improvements", paragraph
F, is hereby amended by adding the words and figures in underlined type, and
by deleting the words and figures in struck-through type, as follows:
Drainage. Storm water shall be contained on site. Containment
capacity shall be designated for a minimum of two and one-half
(2.5) inches of rainfall in one (1) hour. Drainage structures and
french drains shall comply with minimum city standards o~
standards of the South Florida Water Management District. Catch
basins shall be located in grassy areas unless otherwise approved
by the director of development. For impervious areas exceeding
twenty-five thousand (25,000) square feet, the parking lot and
facilities shall be designed and certified by a Florida registered
engineer. Maximum storage capacity of soil shall be considered at
a rate of one (1) inch of water for each six (6) inches of soil above
the water table. Drainage calculations are required in all
instances. The hydraulic conductivity of soil shall be determined
with tests made at the site using test procedures recommended by
the South Florida Water Management District or other procedures
which have been approved by the director of development.
Section 2. Chapter 23, Article II. "Required Improvements", paragraph
H.7. is hereby amended by adding the words and figures in underlined type, and
by deleting the words and figures in struck-through type, as follows:
Number of driveways. Except along the west side of NE 6th Street,
north of Ocean Avenue, Nno more than two (2) driveways shall be
permitted from any property. Where properties abut more than one
(1) public or private right-of-way, additional driveways may be
permitted depending upon traffic volumes, but in no instance shall
the number of driveways exceed two (2) on each street.
Section 3. That each and every other provision of the Land Development
Regulations not hereinbefore specifically amended shall remain in full force and
effect as previously enacted.
Section 4. All laws and ordinances applying to the City of Boynton
Beach in conflict with any provisions of this ordinance are hereby repealed.

Section 5. Should any section or provision of this Ordinance or any
portion thereof be declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the remainder of this Ordinance.
Section 6. Authority is hereby given to codify this Ordinance.
Section 7. This Ordinance shall become effective immediately.
