O97-24 ORDINANCE NO. O97-,~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING CHAPTER 2 - ZONING, SECTION 6.E. "CBD CENTRAL BUSINESS DISTRICT" OF THE LAND DEVELOPMENT REGULATIONS, BY AMENDING SECTION 6. E.l.e. TO PROVIDE FOR HOURS. OF OPERATION FOR DRY BOAT STORAGE FACILITY; BY AMENDING SECTION 6.E.3 TO PROVIDE THAT THERE SHALL BE NO MINIMUM FRONT YARD SETBACK AT ALL FLOORS IN THE CENTRAL BUSINESS DISTRICT; BY AMENDING SECTION 6. E.4.b(1) TO PROVIDE THAT IN CALCULATING REQUIRED PARKING, THE NUMBER OF PARKING SPACES REQUIRED FOR DEVELOPMENT IN THE CENTRAL BUSINESS DISTRICT SHALL BE REDUCED BY FIFTY (50%) PERCENT; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, it has come to the attention of the City Commission of the City of Boynton Beach that amendments are required regarding certain Sections and Articles in the City's Land Development Regulations; and WHEREAS, the City Commission has determined that it is in the best interests of general welfare to the citizens and residents of the City to provide for hours of operation for dry boat storage facilities; and WHEREAS, upon recommendation of staff, the City Commission of the City of Boynton Beach has deemed it to be in the best interests of the citizens and residents of the City of Boynton Beach to amend Chapter 2 - Zoning, Section 6. E.3 of the Land Development Regulations to provide that there shall be no minimum front yard setback at all floors in the Central Business District; wp\ord~natina~ldr chap 2 5/21/97- Rev. 6/17/97 WHEREAS, the City Commission has deemed it to be in the best interests of the citizens of Boynton Beach to promote development in the Central Business District by reducing required parking for development within that zoning district. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section1. Chapter 2 - Zoning, Section 6. E.l.e of the Land Development Regulations of the City of Boynton Beach is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: Marinas, limited to the following uses: mooring and docking of private pleasure craft; sales of fuels and lubricants; occupancy of private craft as living quarters, provided that such craft are connected to public sewer facilities; operation of drift and charter fishing boats and sightseeing boats; bait and tackle shops. Dry storage of private pleasure craft shall be permitted as a conditional use. Service and repair or private pleasure craft shall be permitted as an accessory use to dry storage. Buildings used for dry storage of boats shall not exceed forty-five (45) feet in height, shall be enclosed on at least three (3) sides, and shall be designed so as to be compatible with the intent of the CRA plan, CBD zoning and landscaping regulations, and CBD design guidelines. The hours of operation of a dry storaRe facility shall be no earlier than sunrise and no later than sunset. In addition, other uses may be allowed at marinas, in accordance with the list of permitted and conditional uses for the CBD (central business district). Section 2. Chapter 2 - Zoning, Section 6. E.3 of the Land Development Regulations of the City of Boynton Beach is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: wp\ordLrnafina\ldr chap 2 5/21/97 - Rev. 6/17/97 Building and site regulations. Parking space calculations. Section 4. All laws and ordinances applying to the City of Boynton Beach in conflict with any provisions of this ordinance are hereby repealed. Section 6. Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 7. Authority is hereby given to codify this Ordinance. Section 8. This Ordinance shall become effective immediately. FIRST READING this ~ day of June, 1997.
