AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE NO. O97-01, SECTION 2,
'CLARIFYING THE EXISTING TELECOMMUNICATIONS
MORATORIUM TO PERMIT THE CO-LOCATION OF ANTENNAS
TO EXISTING TOWERS; PROVIDING FOR SEVERABILITY;
CONFLICTS, AND AN EFFECTIVE DATE
WHEREAS, the intent of the moratorium was to apply to new tower
locations and new antennas only, and not to interfere with the location of
an antenna onto an existing tower;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The aforementioned "Whereas" clause is hereby ratified and
confirmed and incorporated herein.
Section 2. The City Commission of the City of Boynton Beach hereby
amends Ordinance No. O97-01, Section 2. By adding the words and figures in
underlined type, as follows:
Section 2. The City Commission of the City of Boynton
Beach hereby extends the moratorium described in this Ordinance,
including but not limited to the placement of any wireless
telecommunication facilities, cable facilities, pole attachments,
open video systems, the installation of all lines, cables, and fibers,
towers and antennas of any nature, other than the standard Florida
Power & Light electric lines for electrical services, standard
Southern Bell telephone lines for telephone service, the co-
location of antennas on existin.q towers and support/n?
structures thereto, and standard Boynton Beach cable television
lines ...
Section 3.
hereby repealed.
All ordinances or parts of ordinances in Conflict herewith are

Section 4. Should any section or provision of this ordinance or any
portion thereof be declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the remainder of this ordinance.
Section 5. Authority is hereby given to codify this Ordinance.
