AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 2.5, SECTION 17 OF THE CITY OF BOYNTON
BEACH CODE OF ORDINANCES TO PROVIDE AN
EFFECTIVE METHOD OF COLLECTION OF FALSE
ALARM SERVICE CHARGES AND/OR FINES; PROVIDING
FOR CONFLICTS, SEVERABILITY, CODIFICATION AND
AN EFFECTIVE DATE.
WHEREAS, the City Commission has determined that a more effective
procedure,for collection of false alarm service charges and/or fines is needed; and
WHEREAS, the City Commission has determined that the current procedure in
the Code of Ordinances is unclear, ineffective, and impractical; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Section 17 of Chapter 2.5 of the City of Boynton Beach Code of
Ordinances is hereby amended to alter the procedure for collection of false alarm
service charges and/or fines, by adding the words and figures in underlined type, and
by deleting the words and figures in struck-through type, and shall read as follows:
The owner of an alarm system in violation of a specified section of this Chapter
shall have ten (10) days from the date of the violation notice to pay the service charge
and/or fine.
(a)
If the owner fails to pay the service charge or fine within ten (10) days the
city shall notify the owner or person in charge of the alarm system by
certified mail that the payment is past due in violation of this section and

vielatie~ that payment be made within ten (10) days of the date of the
demand for payment letter,
(b)
If the owner or person in charge of the alarm system fails to pay the past
due amount within seveP,-(-~ ten (10) days, the city attorney may proceed
by a suit in a court of competent jurisdiction to collect said unpaid service
charges and/or fines from an alarm system owner, and the city attorney
shall have the authority to place a lien against the property served by a
burglar .and/or fire alarm in the amount of all assessed service charges
and/or fines.
(c) The owner of the alarm system and/or the premises the alarm system
serves shall be responsible for all costs incurred in collecting the service
fee including attorney's fees.
Section2. Each and every other provision of Chapter 2.5 not herein
specifically amended shall remain in full force and effect as previously enacted.
Section 3. All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
Section 4. Should any section or provision of this ordinance or portion hereof,
any paragraph, sentence or word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this ordinance.
Section 5. Authority is hereby granted to codify said ordinance.
Section 6. This ordinance shall become effective immediately upon passage.
