introduced the members of the Board, members of the Planning
Department, and acknowledged the following people who were

Florida League of Cities Meeting
Mr. Annunziato stated that he would like to have the Board's
input regarding the League of Cities meeting to be held on
September 15th and 16th in Tampa. He suggested that any
Board member who wished to attend contact him and he would
make the reservations. Chairman Walshak, Dr. Jackier and
Mrs. Huckle stated that they might be able to attend.

Mrs. Huckle made a motion to remove this item from the

Miss Heyden stated that this request had been resubmitted,
as requested by the P&Z Board, by Mr. Yates, Construction
Engineer, with some changes. Miss Heyden explained the
exact location of the proposed McDonald's Restaurant.
The applicant proposed to decrease the size and con-
figuration of the building footprint from 6,000 square feet
to 4,295 square feet. He also proposed to change the
surrounding parking lot to accommodate the restaurant and
drive-through facility. Two drive-through windows would be
located on the east side of the building facing Congress

Avenue. The drive through entrance would be located on the
southwest corner of the building circulating drive-through
traffic counter clockwise around the building with stacking
lanes visible from Congress Avenue on the south and east
sides of the building. The drive-through exit is located on
the northwest corner of the building and the main entrance
would be located on the west side away from Congress Avenue.
One menu board has been eliminated and a menu board with
speaker is to be located on the south side of the building.
Miss Heyden spelled out the standards to be considered when
evaluating conditional uses, and explained that the
egress/ingress access would be by way of the shopping center
driveway onto Congress Avenue. This would allow sufficient
access to the proposed use. Several circulation~ problems
resulted when the shopping center parking lot was modified
to accommodate the McDonalds restaurant drive-through facil-
ity. These problems have been addressed as follows:
The angled drive-through entrance still exists; however,
the north/south access lane had been dead ended at the
drive-through entrance. Four additional parking spaces
were added as well as a landscaped island. This elimi-
nated the original concern but caused new concerns. The
access lane would be used primarily by McDonald's custo-
mers only with the creation of the dead end. Drive-
throughs are more likely to block exit or entry from the
six parking spaces on the west side of McDonald's, and
block access to other lanes to the west. The drive-
through lane can accommodate seven cars before this
situation would occur. It was noted that McDonald's
peaks at that same time the shopping center peaks (at
i P. ~.).
The other traffic problem noted in the original staff
report involves the drive-through exit located at the
northwest corner of the building. It has been alle-
viated by increasing the turning radius between the
drive-through exit and the Catalina Centre north drive.
The potential still exists for congestion in the area
and a bottleneck situation created due to the close
proximity of the exit and the intersection of the access
lane with the Catalina Centre north drive. Not enough
stacking space is provided between the exit and the
intersection. A vehicle would have to make a wide right
hand turn into oncoming traffic to enter the Catalina
Centre north drive.
Reserved parking had not been provided for due to the
tightness of the site. Provisions have not been made

for a person waiting in line should he need to exit the
drive-through. He must wait until he reaches the first
drive-through window to pull out of line.
Shared parking study was required to reflect the pro-
posed changes in square footage. A decrease in the
number of parking spaces was to be reduced from 20 to
17. With the new study, the applicant has added 4 more
parking spaces. 688 parking spaces are provided versus
724 required by code. 36 parking spaces will be shared
with the hotel in Plat No. 1. This would leave a 19.1%
retail buffer at the peak hour.
Dumpsters are still proposed to be located at the
southeast corner of the building. The TRB was concerned
about this location and the liability of locating
dumpsters in areas where sidewalks are not provided and
pedestrians must cross the parking lot where service
vehicles must back out.
The applicant met with the Fire Department to discuss
the problems with the original submittal. The Fire
Department has agreed to delete their comments regarding
access. Customers would have to be evacuated in the
event of fires.
The sewage relief valve has been relocated to alle-
viate the concerns about the unpleasant odors being
released during the normal operation of the sewer force
main along the front of the building.
The Utilities Department recommended

Signage and lighting problems are easy to resolve. The
problem with general compatibility with adjacent pro-
perty still exists.
Miss Heyden reviewed the color scheme for the restaurant and
noted that in general the bulling is attractive and in
character with the shopping center.
The Planning Department recommends this request be denied
due to ingress/egress problems, lack of reserved parking
area adjacent to the drive-through window, lack of room to
pull out of the drive-through lane on the south side of the
building, pedestrian safety concerns, insufficient parcel
size to accommodate a drive-through facility, and the City
Commission's decision not to locate drive-through facilities

where drive-through windows are visible from public
thoroughfares. Tl~e Commission has also not looked favorably
on buildings where the rear facade faces a major thorough-
fare.
James R. Brindell, Gunster, Yoakley, Criser & Stewart, P.A.,
777 South Flagler Drive, West Palm Beach, was present to
represent the applicant. He noted that this was a $1.5 to
$2 million project, and was approximately a $150,000 upgrade
over the standard McDonald's. The store is to be company
owned and run. Many of the customers would be drive-through
customers. Mr. Brindell introduced several people who were
present to address the concerns of staff. Steve Godfrey was
present from Kimley-Horn; Gary Smith, Regional Construction
Manager; Don Rasnick, Operations Manager for Palm Beach
County; Ronald Yates, Construction Engineer; Ray Que, Real
Estate Manager; and Tom McMurrain, Catalina Centre.
Mr. Brindell pointed out the rear of the building as well as
the other elevations on the drawings he had before the
Board. He noted that the landscaping used would match that
used at the Catalina Centre in quality. The exterior of the
building was of a similiar type as the Centre as well and
all was proposed 5o be of high quality ma~terial. He passed
around a photograph of the McDonald's restaurant located at
the Fifth Avenue Shops at Boca Raton. The dumpsters would
have solid metal doors painted to match the Centre's facade
with three sides of block and stucco of the same color and
style as the building.
Mr. Brindell felt that the turnout issue had been resolved
by the increased radius which makes it easier to stay closer
to the radius and does not cause such a sharp turn that would
force a person out. This should crea~e a smoother turn. He
also pointed out that there are approximately 5 storage
areas after a person has left the second window before a
person would reach the turnout. He did agree that a person
would not be able to get out of line until they reach the
second window if that person should change his mind and wish
to get out of line. That would be only a wait of approxima-
tely three or so cars. He pointed out that with the two
window system, a person who must wait for a special order
can pull up to the second window after paying for his meal
and wait at that window. The customers behind him can be
served from the first window and pull around to get out.
The storage issue will be addres'sed by Steve Godfrey. He
noted that the stacking would meet those standards
established by the County. Mr. Annunziato stated that the
City does not have a code which relates to stacking.

Steve Godfrey, Kimley Horn and Associates, Registered
Professional Engineer practicing in the area of traffic
engineering. He was excited about the changes being
suggested to improve the site plan. He referred ~o four
areas of concern. 1) Vehicle storage, 2) Lack of bypass
lane, 3) Parking during special orders, and 4) congestion
and operations at the exit drive. Mr. Godfrey noted that an
exhaustive study of McDonald's drive-throughs had been con-
ducted prior to coming up with the standard which is in use
at Boca Raton. They use the standard of 180' of storage
and provide for 3 cars from the order board back. This
site has i65' of st~cking space. This will accommodate
3 cars. The bypass lane is a matter of preference. Most
people who come into that lane come in for the purpose of
ordering. It would be almost impossible to turn in by
mistake. During peak hours of operation approximately 1
vehicle comes through every 30 seconds so the maximum delay
a~ter ordering wo~ld be approximately 2~ minutes. Mr.
Godfrey referred to the old type McDonald's ~where special
parking was reserved for those waiting for special orders.
In this case the customer will pull up to the second window
and wait for his order. The first window t~en serves as a
collection point for money as well as for delivering orders.
Only about 10 percent of the orders are special orders. The
drive congestion issue has been addressed by ~xpanding the
radius so that a vehicle can go around and'Still stay in its
lane and move into the e~gress lane. A double yellow stripe
would be used, a 12' entry lane provided and a 15' exit lane
to allow for the maneuver as well as identifying where the
individual vehicles are to be. This change has also provided
a straight alignment i~to the aisleway as well so that people
wanting to get to the shopping center could do so easier.
Chairman Walshak mentioned that staff was concerned about
cars pulling out too ~ar into incoming traffic. Mr. Godfrey
stated that was not the case. A 15' radius had been created
and the turn radius was softened. Mr. Annunziato agreed
that when the radius is increased a car can make the turn
more easily, but it can increase the speed of that automo-
bile as well. Mr. Godfrey stated that in this case the 15'
radius is a slow speed amd adequate for parking lots and not
a fast radius. The vehicles exiting will have a stop sign
prior to making the right turn. The double yellow lines
between lanes would let drivers know where their space is.

Col. Trauger stated that he was aware of many good things
which the McDonald's restaurants do such as several years

ago when they paid the hotel bill for a little girl's family
while she had surgery for deafness. He also felt that the
City could be proud of such a nice looking facility. He was
concerned that the congestion in that area is already too
great. He was also concerned that in the future they might
want to expand the facility.
Mr. Richter had been to the McDonald's in Boca Raton which
had been referred to. He had never had to wait in line
longer than a couple of minutes, and those waiting for spe-
cial orders move to the second window to wait with no
problems. He felt that the personnel with McDonald's were
experts in moving traffic.
Dr. Jackier had no comments to make at the time.
Mrs. Huckle was concerned about Mr. Eichorst, Acting Public
Works Director's statement about the location of the
dumpster. He felt the dumpster should be in a service area
and not in a shopping center parking lot.
Mr. Annunziato felt the concern is due to the access from
the parking lot generally. Given the congestion, Mr.
Eichorst felt there was opportunity for something bad to
happen. Chairman Walshak also questioned that and noted
that the dumpster would be serviced from outside of
McDonald's parking lot. Mr. Annunziato stated this was
correct and access is done in an aisle way. Chairman
Walshak did not see this as a problem. This information
cleared it for Mrs. Huckle as well.
Chairman Walshak referred to the memorandum from Joe Swan,
Utilities Department, which stated that it was their opinion
that the subject site was not large enough to accommodate a
building of its size. Chairman Walshak noted that the size
has been cut down from 6,000 to 4,295. Mr. Annunziato
clarified that due to the close proximity of the utilities
to the proposed building, there was a remote chance for
something serious to happen in the event of a break.
There was further discussion regarding the accuracy of the
survey and the comment by the City Engineer. The engineer
for the project stated that the survey is correct. The City
Engineer stated that the location of the water and force
main relative to the building were not as shown.
Roland Yates, Engineer for McDonald's, stated that they
believed the survey was accurate as shown. He stated how
this could be verified using the vents to be relocated.
They were in line with the force main. Mr. Annunziato felt

that Mr. Swan was correct. After further discussion con-
cerning the inconsistency, it was determined that this must
be resolved prior to the City Commission meeting.
Mrs. Huckle felt that most problems had been addressed. She
felt that the City Commission would have to determine how
they felt on the issue of the visibility of the drive-through
windows. This is an aesthetic problem and there is nothing
established in the City's codes. She still had questions
regarding the parking for special orders which was clarified
by Mr. Brindell. He noted that one car can be parking at the
window and there should be space for another to park
directly behind that one and still not interfer with the
cars picking up their orders and driving around to get out.
Chairman Walshak had no problem with the traffic solution
and he felt the building was a beautiful one.
In further discussion, Chairman Walshak suggested that some
extra landscaping might prevent the drive-through windows
from being visible from the street. Mr. Brindell stated
that this could be done easily and they would be glad to do
so.
(At 8:40 P. M. Commissioner Olenik entered the meeting and
was in the audience.)
Mr. Brindell stated that the utility problem would be
resolved prior to the Commission meeting.
Staff Comments are as follows:
Building Department:
The applicant should be aware that logo flags are not per-
mitted in the City. National, state and municipal flags can
be flown from the proposed flag pole. Health Department
approval is required prior to submittal for permit. The
building is required to be accessible to the handicapped.
Show elevations of the sidewalk adjacent to the handicapped
ramp. The Community Appearance Board (CAB) should take note
of the close promixity of the dumpster enclosure to Congress
Avenue.
Fire Department:
As a result of a meeting held with McDonald's representative
(Mr. Yates), the Fire Department withdrew its requirement
and recommendation for a fire sprinkler system.

Engineering Department:
Sheet SP-1 and SP-2 do not show the same dimensions for
driveways. Typical cross-sections thru the driveway should
be shown. A legend should be shown to identify areas paved
with portland cement concrete and typical cross-sections
should be shown. Contractor and inspectors must interpret
plans in the field so details on plan should be clarified
thru blow-ups or larger scale drawing for plan.
Utility Department:
The location of the water and force mains relative to the
building are not as shown. We believe the 16" force main is
approximately 8' from the building pad, and the water main
approximately 20' from the pad. A serious break in either
main would require extensive excavation and repair, and
could conceivably damage the proposed building, thus
incurring added liability to the City. A hold harmless
agreement would be required regarding the normal functioning
of the sewage air relief valve. It is our general opinion
that the subject site is not large enough to accommodate a
building of this size.
Public Works Department:
The dumpster location presents serious safety problems.
This dumpster should be in a service area and not in a
shopping center parking lot.
Planning Department:
The drive-through aisle on the south side of the building is
only ten feet in width and does not meet the twelve feet
required by the parking lot regulations for one-way drives.
Dimension all drive-through lanes on blow-up sheet, SP-2.
Building signage is permitted separately through the
Building Department. Approval of these plans does not
constitute building signage approval. The applicant should
be aware that the new sign ordinance allows flat signs only
on the front of buildings. A sign variance would need to be
applied for through the Building Department. Parking spaces
do not meet 9' x 18' requirement or overhang credit. The
revised shared parking study submitted includes both the
McDonald's and Gerulaltis Tennis Resort. As was noted in
the study, two additional parking spaces have been lost at
the hotel and two lost at the resort since the July 19, 1988
City Commission approval of both projects. A revised hotel
site plan reflecting the lost spaces is required to be sub-
mitted for Planning Department files at the time of final

sign-off for the resort or McDonald's, whichever comes
first. The site date table on the shopping center site plan
should correspond with the parking space calculations within
the revised shared parking study.
Forester/Horticulturist:
The landscape plan should note the type of sod used. Ail
landscaped areas must be irrigated including Congress
Avenue right-of-way. All existing or newly planted hedge
materials must be 36" in height.
Mrs. Huckle moved to approve the application from McDonald's
Restaurant for site plan and conditional use approval to
construct a 90 seat (4,295 square foot) restaurant with a
drive-through window on a leased out-parcel within Plat No.
2 at Catalina Centre subject to all staff comments. Motion
was seconded by Dr. Jackier and carried 4-1 with Col.
Trauger voting against the motion.

Request for relief from Section
5-142(h)(3) "Driveways" of the
Parking Lot Regulations
Mr. Golden described the three requests for Coastal Corners
Service Center 6A2, 6A3 and 6C1. This property is located
on the North side of Boynton Beach Boulevard and is known as
Fred and Joe's Service Station. The applicants are pro-
posing to build two new buildings - a convenience store with
a laundromat and fuel pump islands and a garage for automo-
bile repairs. The convenience store is proposed to be
located on the front of the parcel with the rear along the
west property line and the front of the building facing N.E.
3rd Street and the automotive repair shop to the rear near
N.E. 3rd Avenue. Parking would be at the front and rear of
the garage. Access would be from Boynton Beach Boulevard
with a driveway located within 180 feet of the intersecting
right-of-way lines with N.E. 3rd Street and a driveway onto
N.E. 3rd Street. A parking lot variance is being requested
for the driveway. The 10' wide service alley is proposed to
be abandoned. Southern Bell has requested that the alley
not be abandoned unless it is retained for utility easement
to accommodate the necessary utilities.
The applicant proposes to construct a 32' wide two-way dri-
veway within 38' of the intersection right-of-way lines with
3rd Street. The Technical Review Board recommended the
requests be denied due to the following: 1) Closeness of
driv:eway to the intersection which could cause turning
movement problems, 2) Driveway would not be consistent with
the proposed Urban Design for Boynton Beach Boulevard.
The architecture and design for the buildings appear to
reflect the Coastal Village theme proposed in the Urban
Design plan for Boynton Beach Boulevard. The positioning of
the convenience store and the location of parking areas and
the Boulevard driveway are not consistent with the proposed
Urban Design plan.
Mr. Golden pointed out that the Urban Design plan has not
been fully developed or implemented at this time. In order
for the project to comply with this proposed design, the
building would have to be turned and the parking moved to
the rear of the building. This is not a code violation but

a conflict with the proposed design for Boynton Beach
Boulevard.
Mrs. Huckle asked if the building could be turned around,
and Mr. Annunziato stated that he was not sure. If the
Urban Design Plan was approved at this time~ this request
could not be approved. The landscaping and architecture are
consistent with the Plan.
Mr. Golden stated that the easement is paved but no struc-
tures are located on the easement.
Abandonment Request
Robert Bentz, Land Design South stated that the two existing
structures on this property would be removed and replaced by
more modern facilities. V&C is owned by Fred Violette and
Kevin Clancy who have been working in the area for nine
years. They would like to be the first business (after
Bud's) to make improvements according to the new design for
Boynton Beach Boulevard. Their buildings were designed by
the same architect who designed Bud's. Mr. Bentz had worked
with the Planning staff as well as others in the City in
coming up with the proposal.
Richard Wensing, Architect, stated that he had read the pro-
posed Plan and had talked with the City Planner to get a
feel for the proposed desiqn for the Boulevard. He also
pointed out that the owner~ have an option to buy the piece
of property which lies almost in the center of the parcels
they presently own. He had tried to turn the building
around but it would just not work out. A convenience store
would not work out with the parking in the back. If it is
not convenient, customers will go to another business.
It was pointed out that this would also increase the tax
base. Also, a large curb cut is being given up for a 32'
cut for the driveway. With the present situation, people
back out onto Boynton Beach Boulevard. The new design would
eliminate that. There was discussion regarding distance
from arterial and collector roads. It was also clarified
that the intent of the Urban Design Plan was to abandon N.E.
3rd Street. It would be possible to allow only a right hand
turn out of the property.
Col. Trauger felt that a commendable effort had been made
and he hoped that a domino effect would happen in that other
businesses would want to improve and conform with the new
design for the Boulevard.

Col. Trauger moved to approve the request for the abandon-
ment of a ten foot wide alley right-of-way at East Boynton
Beach Boulevard at N.E. 3rd Street, northwest corner for
Coastal Corners Service Center subject to staff comments.
Dr. Jackier seconded the motion. Mrs. Huckle asked about
the conflict with Southern Bell's comment. Mr. Annunziato
stated that this must be resolved by granting the easement.
The motion carried 5-0.
Parkinq Lot Variance Request

request, THE PUBLIC HEARING WAS CLOSED.
After further discussion, Chairman Walshak stated that a
parking lot variance only comes before the P&Z Board if
approved unanimously. If the vote to approve is not unani-
mous, it must then go to the City Commisison for con-
sideration.
Mr. Richter stated that he agreed with Col. Trauger that the
applicant has made a great effort. He was willing to bend
over backwards to do what he could to help someone from this
area to better his business site.
Mrs. Huckle wondered if they would be setting a precedent by
approving the request. Chairman Walshak did not feel it
would set a precedent. He felt that to disapprove the
request would kill the project.
Mr. Annunziato explained again that the location of the
parking is extremely essential to the proposed Urban Design
Plan.
After further discussion, Col. Trauger moved to approve the
request for relief from Section 5-142(h)(3) "Driveways" of
the Parking Lot Regulations for Coastal Corners Service
Center. Motion was seconded by Mr. Richter and carried 4-1
with Mrs. Huckle voting against the motion.

the hydrant. Cut and plug the existing service. Reduce
pressure backflow prevention devices will be required on
both services. Please indicate on plans. New sanitary ser-
vice shall be of vitrified clay pipe to the property line,
with appropriate cleanouts in the swale area. Cleanouts
must have access covers set in a 2' wide concrete collar.

Engineering Department
Elevation of inlet structures above grassed swale should be
shown. The exfiltration trench should have a straight run
between inlet structures to facilitate cleaning. It is
recommended that the design for the exfiltration trenches
comply with the W.M.D. Technical Publication 87a-5, dated
December 1987. Hydraulic conductivity to be determined from
on-site testing. Type of luminaire should be indiated,
i.e., H.P.S.V. or M.N., etc. The type "C" catch basin shown
in the floor of the maintenance shed has no discharge shown.
This area is not allowed uo discharge into the drainage
system, but plans for disposal of wash water wastes, etc.,
should be shown.

Add a gate valve at the tee to the fire line. Indicate all
utility easements. The fire line should have an easement up
to the post indicator valve, which must be shown. The water
service to the building will require a reduced pressure
backflow preventer. We recommend the feed line to the rinse
tank also have a suitable backflow preventer or air gap.
Floor drains from the vehicle maintenance area to the sani-
tary sewer will not be allowed. All drains an said area
must go to a self-contained sump with no outlet.

Existing drop curbs to be removed and reconstructed to form
a continuous sidewalk where they are proposed to be discon-
tinued. The parking space in the extreme northeast corner
of the site does not allow for proper ingress and egress and

license for this use should be reduced to 120 or less based

Miss Heyden stated that this is the site of the old Party
Liner store. Mr. Kruger proposes to add some trees, move
the dumpster and make some elevation changes. The color of
the building will be light and dark gray with gray doors.
Beril Kruger, 100 East Linton Boulevard, Delray Beach, was
present and stated that this property has been purchased and
the new owner is proposing some exterior changes. He showed
some elevation drawings of the proposed changes. The
dumpster has been eliminated and there will be garbage
pickup outside the gate. Mr. Kruger further explained that
the business will be used to repair alternator, generators,
etc. Cleaning will be done by Safety Clean. Mr. Annunziato
agreed that if the Acting Public Works Director agreed to
garbage pickup, the dumpster could be eliminated. This would
be put in writing before the City Commission Meeting. Mr.
Kruger stated that he will not wholesale automobiles at this
site. If any automobiles are stored on site, they will have
a proper license tag.
Mr. Kruger stated that he agreed with the staff comments and
had already addressed most of them. Mr. Kruger stated that
they would be putting the curbing back in as well as the
sidewalk. Landscaping was also being added. All repair
work Mill be done inside the building. Mr. Kruger stated
that there are 9 parking spaces.

had approved of such a costly project.
E. W. Felca, 1114 Lake Terrace came forward and stated that
he was a member of the Board of Directors. He noted that
the extension will be built on a slab which already exists
and that the building will not extend beyond that.
Mr. Annunziato stated that the survey must be addressed.
Dr. Jackier suggested this should be tabled for more infor-
mation. In answer to Col. Trauger's question, Mr. Felca
stated that the cost of the project and whether the asso-
ciation approved was not the question before the Board.
Chairman Walshak agreed.
After further discussion, Mr. Felca agreed to get the survey
prior to the City Commission Meeting on August 16th. Col.
Trauger stated that he would like a legal opinion from the
owner's attorney.

Please be advised of the Planning Department's comments in
connection with the above-referenced request for site plan

1. The free-standing sign will require future site plan
approval.
2. with respect to the proposed urban design plan for
Boynmon Beach Boulevard, it is staff's opinion
that the plans should be modified Ito the greatest exsent
possible) to reflect the following design requirements:
a) A 5' wide privately owned planting strip is
required between the building setback line and the
greenbelt area in all new and rehab developmen~
areas. Planting and paving in this area mus~ be
coordinated with public greenbelt improvements
to ensure an appropriate blending of materials.

b) A residential buffer (which includes a 6'0" wall and
landscaping) shall be installed where a non-residential
use is developed or rehabilitated adjacen~ to a

Parking lots between the front property line and the
front of the-building (or between the side of the

prohibited. Parking is prohibited between a
building (side) and main access drive off the Boulevard
to maintain a continuous building facade along the

required to provide access to parking areas. It is
recommended that service stations/gas stations

Items c, d, and e will require that the convenience store/
laundromat building be turned to face Boynton Beach Boulevard
rather than N.E. 3rd Street, and that the fuel pump islands be
placed_on the east side of the relocated building or at the rear
of the building. This will also require that the parking be
relocated at the rear of the building consistent with the urban
design plan and will eliminate the need for a parking lot
variance fora driveway onto.'Boynton Beach Boulevard (see memo
concerning the Tschnical Review Board recommendation on the
parking lot variance request for a further explanation). As an
alternative to a driveway onto B~ynton Beach Boulevard, two
driveways could be placed on N.E. 3rd Street.
In addition to the above, landscaping and signage should conform
to the urban design plan to the greatest ex~en~ possible.

Regarding the site plan for the Coastal Corners Service Center, the following areas
do not comply with the concept of the Design Guidelines for Boynton Beach Boulevard.
For all commercial development along the Boulevard (East of 1-95) the following site
planning arrangements shall be used (see exhibits 5, 6 & 7). p.15.
Buildings shall orient their main, public entrance towards the Boulevard.

1. The site plan data table does not reflect the number of
parking spaces that were added with the last site plan
modification.
The number of parking spaces on the application does not
correspond to the count on the site plan.
The commercial building was approved at one (1) parking
space for every 200 square feet of gross floor area and
the office building au one (1) parking space for every 300
square feet o~ gross floor area with the original site
plan. This equates uo a requirement of 150 spaces to be
provided; 155 are provzded on site. Restaurants require
one (1) parking space for every 100 square feet of gross
floor area.: more than double the parking requirement
that was established for the commercial building where
Nick's Diner is proposed. Because of the tight parking
situation, future approval of uenants that would
normally require more than one (1) parking space per
200 square feet of gross floor area will necessitate a
reevaluation of the parking situation for the
commercial building.

The applicant is requesting an amendment to reduce the rear yard
setback from fifteen (15) feet to eight (8) feet to allow for the
addition of screened enclosures with solid roofs. At the August
2, 1988 Technical Review Board meeting, two issues were noted
with respect to this resubmission request:
(1)
There is a ten (10) foot wide landscape
easement which abuts Boynton-Beach
Boulevard that would preclude the
reduction of the rear setback to eight
(8) feet for lots I through 12.
(2)
Appendix B of the Planned Unit Development
Regulations, Section 9B-Internal Lots and
Frontage, requires that "peripheral yards
-abutting other zoning districts shall be
the same as required in the abutting zone."
Lots 94 through 105 abutt a PU, Public
Usage, district which requires a 25 foot
rear setback. Therefore, the rear yard
setback for lots 94 through 105 would have
to maintain a 25 foot rear setback also.
(3)
Lots 17 and 18 abut the Knuth Road right-of-
way with no common area buffer. On the original
master plan the rear setback requirement for
lots 17 and 18 is 25 feet rather than 15 feet
that is required for most other lots.
For these reasons the Technical Review Board recommends that
this request be approved for all lots, excluding lots 1-12,
94-105, a~ 17 and 18.

BOYNTON LAKES PLAZA-SITE PLAN STAFF COMMENTS
Please be advised of the following Planning Department comments
with respect to the above-referenced site plan request:
A note has been added to the plans that rooftop and
ground-mounted mechanical equipment will be screened.
More detail is needed to determine whetherthe proposed
parapet will provide adequate screening or whether the
parapets have to be raised as the mechanical eq/lipment
has not been located.

The parking lot setback from the west property line
along Congress Avenue has been dimensioned as plus or
minus ten (10) feet. The minimum setback in this area,
including a two (2) foot overhang, is seven (7) feet.
Specify this exact dimension on the site plan.
L%ghting plans do not indicate wattage and an energy
efficient light source.
The number of cinema seats on the site plan must correspond
with the 2,124 seats indicated within the shared parking
study.
5. A construction detail for the perimeter buffer wall must
be provided.
6. The four (4) foot landscape strip used to meet the 2 foot
overhang credit ls proposed to be planted with trees. If
tb~ landscaping is not needed to meet the landscape code,
the trees will need to be removed and planted elsewhere. If
the landscaped area is needed, the Strip will need to be
increased to s~ven (7) feet to accommodate a two (2) foot
overhang and landscaping.
7. With respect tQ the proposed freestanding pylon signs on
Congress AvenuD and Hypoluxo Road, please be advised that
tb~e City's new sign regulations would allow a maximum area
of 160 square feet per sign. Advertising ~or tenant
occupancy and movie listings would not be permitted as is
shown on sheet 5 of 5. This information should be removed
frDm the signage details. Any change other than the.above
will require a future site plan modification.

Building signage is permitted separately through the
Building Department. As part of the permitting process
an "overall design scheme"'is required to be submitted
and approved by the community Appearance Board and City
Commission. (Contact Don Jaeger, Building Department, for
further information on the new sign regulations.)

As per the previous site plan approval, it is recommended
that the developer post a bond for future traffic signals
at the following intersections:
a) Congress Avenue and Plaza Lane
b) Hypoluxo Road and Boynton Lakes Boulevard.
~he Planning Department would like to make the Planning and
Zoning Board, Community Appearance Board and City Commission
aware that three (3) leased outparcels are proposed for this
shopping center, including a convenience store (Stop and Go)
and two restaurants (Olive Garden and a future Kentucky
Fried Chicken restaurant which must undergo future
Conditional Use Approval for a drive-throughwindow).
At the September 6, 1988 Technical Review Board meeting,
the Technical Review Board recommended approval of a shared
parking study for Boynton Lakes Plaza based upon the
methodology presented. The Boynton Beach Code would require
1,051 parking spaces, without shared parking.

The methodology presented using, U.L.I. data, supports the
o~portu~ity for sharing to occur ~etween.~the retail
(including restaurants) and the cinema at the
2:00 p.m. weekend peak for the shopping center. The
recommendation for approval was based upon the provision of
777 parking spaces allowing a 10.5% buffer (a 10% minimum
buffer is required by code).

owner shall receive financial reimbursement for the
condemned right-of-way from Palm Beach County and
no density credit shall be granted. This would result

The structures must be accessible to the~andicapped and
comply with Chapter 533, Part V, Florida Accessibility
Codes and Standards. Handicapped parking stalls should
be lo~ated adjacent to buildings which provide accessible
units. Provide de%ails on all handicapped ramps and ele-
vation changes from the parking area into the living units.
Details of the dumpster enclosure must be provided. The
dumpster must be enclosed on three sides by a six (6) foot
high, CBS wall.
South Florida Water Management District approval and Lake
Worth Drainage District approval is required.
State and county Department of Transportation permits must
be secured for work in the Boyntcn Beach Boulevard and Old
Boynton Road rights-of-way, respectively.
5. The site plan should include all proposed signage.
6. The site plan should include a horizontal control drawing
indicating the exact location of all structures.
7. Light poles must be designed to withstand a 120 miles per

Sign details A-5, A-7, A-8, A-9 are temporary signs
which do not require site plan approval, but are
permitted separately through the 'Building Department.
Temporary signs are regulated by Sec. 21-15(a) and (b)
of the new sign ordinance.
2. Signs A-3 and A-4 will need to be located on sheet 1,
site plan.
The new sign regulations for Planned Industrial Districts
'do not set forth size restrictions for special, signs that
would be unique to a particular use. Several such slgns
that Quantum Park is proposing are individual land use
section signs (B-4), special amenity signs (B-5, B-6
identifying the Fitness Center, Sand Pine Preserve and
Wetlands), bike path/jogging trail signs (B-7) and park
rule signs (B-8). It was intended that these signs
would be evaluated on a per case basis by the Planning
and Zoning Board, Community Appearance Board the City
Con~..ission after a recommendation from the Technical
Review Board.
Aftem considering other signs in various zoning districts,
it is recommended that the land use and.special amenity
signs be limited to 32 square feet. This is the current
size restriction for freestanding signs in commercial
zoning districts for individual land users. Also, it is
recommended that the park rule and path/trail signs be
limited to four (4) square feet after evaluating various
signs in Sec. 21-15 Special Signs.
As a point of information, the above-referenced, proposed
signs conform to these recommendations with the exception
of the 38.5 square foot land use section sign which the
app~cant has agreed to reduce to thirty-two (32) square
feet.

Palm Beach County sixty (60) feet from centerline,

As per Appendix A, Sec. ll-H.16.f(5), 145 parkinq
spaces are needed for this project based upon on~
space per 800 square feet of gross floor area, but
not less than ~wo (2) spaces per rental unit of
500 square feet of gross floor area or greater. The
applicant has provided 143 spaces. Parking space and
square footage changes should be reflected on the
application and sheet A-1.
A dumpster enclosure detail is needed showing a
minimum 10' by 10' concrete slab with a six 6' high
CBS masonry wall on three (3) sides to match building.
A minimum ten (10) foot opening is required.
Elevations do not indicate colors to be used.
No lighting plan has been provided showing light curves,
one footcandle per square foot minimum illumination level,
photocell activation, wattage, energy efficient light
source, manufacturer's specification, and pole mounting
detail.
The small parking lot along Congress Avenue does not
conform to parking lot and landscape regulations. If
parking spaces are to be 9 feet by 16 feet, the
landscape strip abutting such spaces will need to
be a minimum of 4 1/2 feet along adjacent property lines
to credit a 2 foot overhang.
