ACKNOWLEDGEMENT OF _MEMBERS AND VISITORS After the Pledge of Allegiance to the Flag, Chairman Walshak introduced the members of the Board, members of the Planning Department, and acknowledged the following people who were present in the audience: Acting Mayor Heater, Commissioner Mar~hese, Commissioner Olenik, Commissioner Mann, City Manager Cheney, Johnnetta Broomfield (Community Improvement Director), Simon Ryder (past Chairman of the Planning & Zoning Board), Pearl Wische from the Community Appearance Board, Lee Wische from the Parks and Recreation Board, and noted that former Mayor Cassandra stopped by briefly. APPROVAL OF MINUTES OF JUNE 14, 1988 Mrs. Huckle wished to mention that the original minutes have been corrected as follows: 1. Page 7, paragrah 2, line 11 "aesthecally" has been changed to "aesthetically." 2. Page 17, Cross Creek: The vote should be 6-1 with Mrs. Huckle casting the dissenting vote. 3. Page 18, paragraph 2, line 2 "removate" should be "renovate." Mrs. Weiner moved to approve the minutes as corrected. Request for an amendment to the Future Land Use Element of the Comprehensive Plan from "General Commercial" to "Local Retail Commercial" and rezoning from C-4 (General Commercial) to C-2 (Neighborhood Commercial) in connec- tion with the proposed rezoning from C-4 to C-2 for the west side of North Federal Highway. This request was continued from the June 14th meeting as the economic analysis had not been received. The economic analysis had been received and this issue was discussed. The area under consideration is a 2300 foot strip of land on Federal Highway. The depth in some areas is 100 feet. When the City Commission was revIewing the request to rezone the east side of Federal Highway, they requested that the staff also look at the possibility of rezoning the west side of Federal. Miss Heyden noted that the lots on the west side back up to the railroad and they are very shallow. If the zoning is changed, many of the lots will become non- conforming uses. This would increase the number of non- conforming uses from one lot to nine lots. She also pointed out that these nine lots have eight different owners. The Planning Department stated that due to the lack of adequate C-4 zoning in the City amd the fact that so many of these lots would become non-conforming~uses, they were recom- mending that this request for re~oning be denied. To grant the rezo~ing would prohibit the businesses from being able to sell as the lots are of such configuration that it would be nearly impossible to use them for a business. It was felt that stricter code enforeement m~ght be appropriate to clean the area up and make it more aesthetically pleasing. Chairman Walshak felt that rezoning would lower the property values. Mr. Annunziato felt this was true, but felt that this would not be true for the land on the east side of Federal ~ighway. The lots on the east side are much larger and they do not back up to the railroad or M-1 zoning. - 3 - MINUTES - PLANNING & ZONING BOYIqTON BEACH, FLORIDA BOARD JULY 12, 1988 Col. Trauger asked if any problems would be created, as these lots are part of the Community Redevelopment District. Mr. Annunziato did not feel that it would. He felt that code enforcement was the real issue on the west side. He noted that the businesses on the west side are active businesses and serve a purpose in the community, and to rezone might cause adverse results. As this was a public hearing, Chairman Walshak asked if anyone wished to speak IN FAVOR of the request. Hearing none, he asked if anyone wished to speak AGAINST the request. Paul Parker, 400 S. 57th Avenue, Lake Worth, represented Mr. Bauer and Mr. Weiss, and stated that he had been waiting for some time to review the staff report. He was in agreement with the staff report and also felt that the west side of Federal Highway was an entirely different situation than the east side. He noted that some of the businesses on the west side have been there for 25 or 30 years, and it would be a "taking" to down zone those properties. He urged the Board to consider the staff report and deny this request for rezoning. Philip Bacon, 1310 North Federal Highway, owner of the car wash located on the east side of Federal, stated that he agreed with the staff report. He noted that the people on the east side feel much the same way about their property. He felt that it was not so much the type of business, but how that business was maintained. He felt the City should do more in the area of clean-up/fix-up and have a strict code enforcement program. He asked if the issue regarding the east side of Federal Highway still had to go before the City Commission, and was told that it did. Chairman Walshak was under the impression that if one side was rezoned the other would be also, or if one was denied both would be denied. Laura Steventon, 705 Shore Drive, stated that many small businesses in this area had failed and she mentioned several. She noted that the traffic situation is terrible. She stated that since these businesses are surviving, the City should be happy that they are in business and paying taxes. Arnold Rogers, 4135 Venetia Boulevard, Jacksonville, Florida, owner of the closed one-stop gas station at 10th Avenue in Boynton, and had to close his business due to crime problems. He supported the staff's position. He - 4 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 12, 1988 noted that in C-2 zoning, a lot must be 100' deep and he only had an 80' deep lot. He could not build anything on his lot. Since his building has been closed, it must now be brought up to code. He is unable to do this due to its size. He felt that the City needs to work with some of the setbacks, landscape percentages, etc. to assist the land- owners if the objective is to make the area look better. Mike DeLuca, 1115 N. Federal Highway, owner of the adult entertainment business, stated that if the zoning was changed he would never be able to sell his business as it is a nonconforming use. As no one else wished to speak FOR or AGAINST the issue, the PUBLIC HEARING WAS CLOSED. Mrs. Huckle felt that the zoning is proper as it now exists due to its location with the railroad in back and the con- figuration of the lots. She noted that there is very little C-4 zoning in the City and felt that some is needed. She felt that the businesses which exist could be greatly improved as far as their appearance is concerned. Vice Chairman Blanchette felt the same way and that the City must come up with some plans for these businesses. suggested leniency for Chairman Walshak stated that his position had been made clear. He felt that the businesses have been in existence and to change the zoning at this time, after they are established, would cause them to lose money. He further stated that the P&Z Board voted 7-0 against the rezoning of the east side of Federal Highway. Mrs. Huckle moved to accept the Planning Department's recom- mendation and DENY the request for an amendment to the Future Land Use Element of the Comprehensive Plan from "General Commerical" to "Local Retail Commercial" and rezoning from C-4 (General Commercial) to C-2 (Neighborhood COmmercial) in connection with the proposed rezoning from C-4 to C-2 for the west side of North Federal Highway. Mr. Golden explained that this request would allow the floor plan to be flipped and the easement would be placed on the east side in lieu of the west side. Staff recommended this request be approved subject to the new easement being established. Donald E. Elliot, agent, was in the audience and stated that they accepted the staff comments. Mr. Richter moved to approve the request for the abandonment of a ten foot wide utility easement (Lot 8, Block 8) in BOYNTON LAKES, Plat No. 6 located on the East side of North Congress Avenue, south of Hypoluxo Road, subject to the new easement being provided on the opposite side of the lot. Request for the abandonment of a four (4) foot wide utility easement (Lot 1, Block 1). Mr. Golden stated that when the new survey was done prior to selling the property, it was discovered that the building sits on top of the easement. In order for Ms. Van Otteren to sell the property she must have a clear title to the prop- erty. The Utility Department recommended approval of the request if the two inch water main is capped at the two limits of the abandonment and that the Utilities Department be notified when this has been completed. Gladys D. Van Otteren, 312 Nathan Hale Road, West Palm Beach, was present to answer questions from the Board. She noted that the City had issued the permits which allowed the building to be built at this location. She further requested that she not have to pay all the costs associated with the capping of the line as it would be a hardship for her, and she did not feel it was her fault it was allowed to exist. Ms. Van Otteren was told that she would have to address that request to the City Commission. As no one wished to speak IN FAVOR OF or AGAINST the request, THE PUBLIC HEARING WAS CLOSED. Col. Trauger moved to grant the request for the abandonment for a four foot wide utility easement (Lot 1, Block 1) with the stipulation that the water main be capped at the two limits of the abandonment and that the Utility Department be notified when this has been completed. Request for the abandonment of a fifty (50) foot wide local street (S.E. 10th Avenue) abutting Lot 1, Block 25 and Lot 6, Block 24, adjacent to the Florida East Coast Railroad right-of-way. Mr. Golden stated that approval of this request would allow Mr. Daughtrey and Mr. Kitching to enlarge their properies and create more parking space. This area is needed for util- ity easements, and the City Engineer recommended that the request be approved with the stipulation that the entire abandonment area be a utility easement and used for parking only. Mr. Daughtrey was present and he was in agreement with the staff comment regarding the utility easement and use of the property for parking only. Mrs. Huckle moved to approve the request for the abandonment of a 50 foot wide local street (S.E. 10th Avenue) abutting Lot 1, Block 25 and Lot 6, Block 24, adjacent to the Florida East Coast Railroad right-of-way, subject to the entire right-of-way being used as a utility easement and that the area of abandonment be used for parking purposes only. E-4 canal. Section 20, Block 0, Lot 502, East 1/2 of S.E. 1/4 of S.W. 1/4 of S.E. 1/4 South and West of County Road, less State Road right-of-way, Plat Book 3420, Page 39 Palm Beach County. Request for master plan approval to construct 204 multi-family rental apartment units on 18.91 acres. Mr. Golden stated that an updated survey provided space for additional units bringing the number from 199 to 204 units. The design has been changed with the discovery of the addi- tional acreage. Jim McManes, 1451W. Cypress Creek Road, Ft. Lauderdale, developer for the property, was present. He explained that the 12 unit buildings had been deleted and 6 unit buildings would be built. Mr. McManes noted that there will be two tennis courts and a swimming pool. These are to be one and two bedroom rental units in the price range of from $585 to $700 per month. The buildings will all be two story and of masonry type constuction. Mr. McManes stated that he accepted all staff comments which are as follows: Parks Superintendent Subdivision dedication for open space is 204 units at .015 = 3.06 Acres less 1/2 credit - 2.53 Acres* 1.53 Acres The requirement will be dollars in lieu of land at an amount to be determined by the Planning Department. In order to qualify for the 1/2 credit for private recreation provided, the developer should: 1) List the 5 separate recreation elements to be provided; 2) Show sufficient detail to demonstrate commercial grade playground equipment and picnic facilities will be installed; 3) List square footage data on the swimming pool and recreation center; and 4) Show specifications on the tennis court lights. *Should be "1.53" rather than "2.53". See minutes of 8/9/88. Building Department Refer to Section ll-H(16) of Appendix A, Zoning, for proper parking calculations. - 9 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 12, 1988 Utilities Department Approve plan subject to the following: 1) Delete the section of the water main along the south entrance road so as to form one continuous loop on the southwest end of the project, with no short-circuiting, and 2) Comments from their June 8, 1988 memo still apply - Specify the size of all water mains (additional valves will be required), add a note to the effect that the City will maintain main line gravity sewers only, the lift sta- tion site must be a minimum 30' x 30' size deeded to the City; water mains must have a minimum 10' clearance for all buildings (sewers must have a minimum clearance of twice their depth, and water service lines must be "K" copper due to construction under pavement.) Planning Department The parking calculations shown on the master plan are incorrect with respect to the requirements for the single-bedroom units. Only 18 units qualify for the 1.5 square foot per unit reduction. Detailed parking claculations for recreation facilities must be provided at time of site plan approval. Engineering Department Permits will be required for the connection with S.R. 804 and Old Boynton Road with the State D.O.T. and Palm Beach County Engineering Department respectfully. The warrants for a traffic signal at the S.R. 804 inter- section should be investigated. Bicycle paths should be constructed of Portland Cement concrete. Mr. Golden stated that this request is for the 466 units only as the 59 units allocated to American Development Corporation have been removed. On July 5th the City Commission made a finding of no substantial change and for- warded this request to the P&Z Board for consideration. The Technical Review Board recommended approval subject to the following comments from the Planning Director: "With respect to the change requested by Mr. Sowards, the Technical Review Board met on Tuesday, July 5, 1988, to review the plans and documents submitted, and they offer for your consideration, a recommendation that the City Commission make a finding of no substantial change for the requested modification, conditioned upon the following: 1) That the City Attorney review and approve the docu- mentation submitted by the property owners which provides for their consent to enter into this appli- cation. 2) That the applicant's traffic engineer submit the information necessary to determine if the new traf- fic distribution pattern for this development will affect the level of service at the N.W. 22nd Avenue/Congress Avenue intersection at buildout of the project and the thoroughfare plan. 3) That the County Engineer reviews and approves the proposed design configuration for N.W. 22nd Avenue referenced in Attachment "B" of the Kimley-Horn report dated 6/30/88. - 11 - MINUTES - PLANNING & ZONING BOARD BOYI~TON BEACH, FLORIDA JULY 12, 1988 4) That the developer of the Gerulaitis multi-family project (C&R Properties) provide a five (5) item recreation package which meets the approval of the Parks and Recreation Department for a 50% credit to the Parks and Recreation Department dedication fee, as per the previous master plan approval. 5) That the site plans submitted for the remainder of the PUD south of N.W. 22nd reflect conditions %1 through ~4 above. Mr. Golden gave an overview of the project explaining that it was proposed to build 78 single-family detached units. The road through the project would be called Tara Lane North and Tara Lane South. There would be a landscaped buffer around the property from Knuth Road. Water would be pro- vided by connection to a 10" exising main and there would be a gravity sewerage system which connects to the Lakes of Tara subdivision. Bob Bentz, representing Land Design South, stated that he agreed with the staff comments but had questions regarding the requirement for street lighting by Florida Power and Light Company in the public right-of-way, and he will meet with Mr. Clark, Engineering Director, to discuss this requirement. He also wished to talk with Mr. Swan, Utilities Department, regarding the need for a diesel generator as part Of the lift station package. He needed some time to evaluate the comments (which he had just r~ceived) made by the Police Department and the Forester, but did not feel there would be any problems. Staff comments are as follows: Planning Department As per previous staff comments for zoning approval, right-of-way for S.W. Congress Boulevard and Knuth Road to be dedicated to the City of Boynton Beach. The engineering plans for Knuth Road and S.W. Congress Boulevard must reflect the improvements that were included in the staff comments at the time of zoning approval. Project signage to be clarified and resubmitted for fUture site plan approval. Forester/HortiCulturist The applicant must provide a tree management plan for the existing Live Oak and Scrub Oak trees. -13- MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 12, 1988 Ail landscaped areas must be irrigated, including the road right-of-ways. Chairman Walshak was concerned that staff comments were being received too late to get them to the applicant prior to the meeting. He felt that some time is needed to review the comments to see if the applicant can comply. Mr. Annunziato stated that the staff does its best to get the comments to the Board and the applicant as quickly as possible. Mr. Richter moved to approve the request for the approval of the construction plans and preliminary plat which provides for the construction of 78 single-family detached units plus landscaping in connection with a previously approved planned unit development subject to all staff comments. He was working to try to tie the whole project together and did not wish to build a fence which would defeat his purpose. He was told that a request such as this must go to the Board of Adjustment for a variance. Benjamin Aaron, 300 N.E. 12th Avenue, Hallandale and Joseph Glass, 301 N.E. 14th Avenue, ~allandale, were owners of the office spaces mentioned above. The applicants had seen the staff comments and were concerned about the requirement to seed and mulch the property. They pointed out that this area is already covered with grass. These documents must be signed and sealed and indicate how all proposed loads will be carried by the existing roof system. The satellite dish must be screened on three sides to a height equivalent to the total height of the mounted satellite dish. (This requirement will be contingent upon Ordinance 88-35 receiving second and final reading from the City Commission.) Planning Department Indicate the height of the satellite dish to the top of the dish including the mounting device. The satellite dish will not be visible within a 365 foot radius from the dish, however at a distance greater than 365 feet, such as Congress Avenue and the multi-family residential project west or behind the shopping center, the dish will be visible. - 23 - MINUTES - PLANNING & ZONING BOARD BOTfNTON BEACH, FLORIDA JULY 12, 1988 It is recommended that the dish comply with the new satellite dish ordinance that was approved at the July 5, 1988 City Commission meeting upon first reading and will be scheduled for second reading July 19, 1988. The ordinance will require screening on three sides to the top of the dish. Ellen Duffer, representing Service Merchandise, stated that they have roof mounted satellite dishes on all their stores throughout the country to provide communications between their stores and the home office. She was not sure how they would comply with the requirement for screening on three sides of the dish. Chairman Walshak was concerned that the City was requiring an applicant to be willing to comply with an ordinance which was not in fact law at the time of their request. He felt that the staff should make the applicant aware of pending ordinances but not'ask them to comply with something which does not currently exist. Ee also felt that the satellite dish would create problems on the roof. There was the problem with the weight of the dish on the roof, the hurricane hazard it could create in this area, and the fact that it would be visible. He felt the dish should be ground mounted and screened. Mr. Richter felt that the City was going to have to deal with upcoming technological developments and work to accom- modate the needs of the businesses in this area. There was further discussion. Mr. Richter moved to approve the request for approval of an amended site plan to allow for the addition of a roof- mounted satellite dish antennae at Service Merchandise. The TRB recommended approval subject to the following comments by staff: Planning Department Indicate building setback from S.W. 26th Avenue for four-plexes on sheets 2 of 18 and 3 of 18. Engineering Department Note that the private spot light fixtures planned to uplift Palm trees in the curbed median of S.W. 26th Street at $.W. 23rd Avenue and at Woolbright Road are privately owned and operated and are occupying a public right-of-way. I don't believe this should be a problem but should be brought to the attention of the P&Z Board and the City Commission for their approval. Copies of the Florida Power & Light Company lighting plans for the parking lot should be forwarded to the City for review. Street lighting plans (see note No. 3 on sheet 2 of the Paving and Drainage plans) "by others" have not been reviewed or approved and should be submitted as soon as possible. Since a variance was granted for the purpose of deleting curbing around driveway areas to individual units, the curbing should be deleted from the engineering plans on sheet 12 of 18 where these conditions exist. Mr. Annunziato was concerned that the dumpster enclosure had not been built to plans and now a wall would have to be removed in order to bring the dumpster into compliance with the approved drawings. Mr. Golden stated that the Public Works Director noticed that the enclosure was being improp- erly installed and spoke with the owner but the owner disregarded his comments. Mr. Roman then asked if a fence could be installed on the north end. Chairman Walshak asked if he was in agreement with the staff comments and Mr. Roman stated that he was. Stsff comments are as follows: Public Works Department The site plan submitted does not accurately show your dumpster location. I also do not feel that with the proposed fence a sanitation vehicle will be able to enter this site for the purpose of emptying the dumpster. Mr. Richter moved to approve the request for an amended site plan to allow for the addition of a perimeter chain link fence at the Solomon Industrial Building subject to staff comments. Motion was seconded by Mrs. Huckle and carried 6-0. D. OTHER CONSISTENCY REVIEW - Proposed amendments to Section ll-H(13) of Appendix A, Zoning, shared parking requirements. Mr. Golden stated that this amendment was proposed to simplify and clarify the language regarding the number of parking spaces required. The amendment would simply require a 10% buffer for everyone which should greatly simplify the process of calculating the number of spaces required for a project. The new language reads as follows: "Parking spaces required in this ordinance for one use or structure may be allocated in part or in whole for the required parking spaces of another use or structure if quan- 27 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 12, 1988 titative evidence is provided showing that parking demand for the different uses or structures would occur on dif- ferent days of the week or at different hours. Quantitative evidence shall include estimates for peak hour/peak season parking demand based on statistical data furnished by the Urban Land Institute or an equivalent traffic engineering or land planning and design organization. Quantitative evi- dence may also include, where appropriate, field studies and traffic counts prepared by a traffic consultant experienced in the preparation of parking studies. In addition, a mini- mum buffer of ten (10) percent shall be provided to ensure that a sufficient number of parking spaces are available at the peak hour/peak season of parking demand. Calculation of said buffer shall be based on the total number of parking spaces determined to be required at the peak hour/peak season of parking demand. Evidence for joint allocation of required parking space shall be s~bmitted to the Technical Review Hoard, and approval of joint allocatin of required parking spaces shall be made by the City Commission, after review and recommendations by the Planning and Zoning Board."
