MINUTES OF THE PLANNING AND ZONING BOARD MEETING HELD AT PINELAND PLAZA, B~)YNTON BEACH, FLORIDA, TUESDAY, JUNE 14, 1988 AT 7:30 P. M. M. and Jessica Turnoff, a sophmore at Boca Raton High School, sang the National Anthem. ACKNOWLEDGEMENT OF MEMBERS AND VISITORS Chairman Walshak introduced the members of the Board, mem- bers of the Planning Department, and acknowledged the following people who were present in the audience: Mayor Cassandra, Vice Mayor Hester, Commissioner Marchese, Commissioner Olenik, City Manager Cheney, Johnnetta Broomfield (Community Improvement Director), Laura Hubbard (Public Information Officer), Simon Ryder (past Chairman of the Planning & Zoning Board), Jean Sheridan and Pearl Wische from the Community Appearance Board, Lee Wische from the Parks and Recreation Board, and Pamela Hasterok (Reporter from The Palm Beach Post). APPROVAL OF MINUTES OF MAY ~10, 1988 Mrs. Huckle wished to change the word "enumeration" on page 20, last sentence to read "remuneration.' Mrs. Weiner moved to approve the minutes as corrected. Motion was seconded by Mr. Wandelt and carried 7-0. ANNOUNCEMENTS Mr. Annunziato stated that he had passed out additional memoranda to the Board members prior to the meeting which should become a part of the agenda packet. He requested that the working paper be reviewed and kept for future reference. COMMUNICATIONS None. OLD BUSINESS Chairman Walshak reminded the Planning Director that the Board suggested to the City Commission that the Technical Review Board come to the Planning and Zoning Board with a negative/positive reaction to applications. He wished to know the status of that request. Mr. Annunziato stated that he did not have an answer, but would have one at the next meeting. NEW BUSINESS A. Mr. Annunziato stated that the economic analysis which had been requested had not been received, and requested that this be continued until the July 12, 1988 Planning and Zoning Board Meeting to b~e held at 7:30 P.M. in Commission Chambers~ 211 South Federlal Highway, Boynton Beach. He also noted that no further notiice would be mailed to interested citizens. The announcement at this meeting would serve as notification. The list is attached as Addendum A to the original copy of these minutes in the Office of the City Clerk. Mr. Golden explained that this property is zoned R-3 and is located at 317 South Seacrest Boulevard. It is a single family home which will be converted to a group home. Four parking spaces will be provided and entrance will be from a single driveway on S.W. 3rd Avenue. The applicant pro- poses to close the loop driveway which has two points of access. The Planning Department recommended approval sub- ject to staff comments (attached to the original copy of these minutes as Addendum A1 on file in the Office of the City Clerk). There was some discussion regarding the need for the stop sign at the driveway exit. Mr. Golden explained that since there will be four parking spaces, the applicant must adhere to the Parking Lot Regulations. Michael Picard, Construction Consultant, explained that he felt this home would benefit the neighborhood. It would be nicely landscaped and the only thing which would make it different from the other homes in the area would be the screening landscaping. Mr. Annunziato read the information provided regarding the four girls who will occupy the home. Mr. Picard explained that the girls will live in the home with a couple who will strictly supervise them. The girls will attend school and live as normal a life as possible in a family type situation. Dr. Jackier asked if there were other group homes in the area, and Mr4 Annunziato stated there were none. In answer to Mrs. Huckle's question, Mr. Picard stated that these were the same four girls who were living in the group home in Golfview Harbor but he did not know where they were living at the present time. Mrs. Huckle was concerned because she heard at the City Commission that that home was not well kept and the girls were very noisy. Vice Mayor Hester stated that one of the girls attends the school where he teaches and she fits right in. As this was a PUBLIC HEARING, Chairman Walshak asked if anyone wished to speak IN FAVOR of the request. Jean Sheridan, 721 S.W. Lake Court, stated that she had a special interest in this request as her son operates a group home in New York which houses seven boys. She stated that this home is well run and is an asset to the community even - 4 - MINUS%ES -~PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 14, 1988 though these are boys who had problems with drugs, etc. She pointed out that the girls living in the group home requested are abused and she felt that the group home should be approved. H. Kravitz, Seagate, stated that his daughter runs group homes in New Haven. These homes are in a beautiful neigh- borhood and are well kept, and the children are well super- vised. The last two homes have been established in condominiums. The condominium owners protested but Judge Downing ruled they should be allowed. Mr. Kravitz felt that this was working out well and the children benefit as well as the residents. Lee Wische, 1302 S.W. 18th Street, stated that he wished to clarify that the group home in Golfview Harbor was well kept and Reverend Dye would verify this as well. He saw no reason for objections to this request for a group home. Chairman Walshak asked if anyone wished to speak AGAINST the subject request. Victoria Castello, 406 S. Seacrest Boulevard, stated that she lives diagonally across from the proposed home. She had read the code and did not feel that provisions are made for group homes in R-3 zoning districts. Mr. Annunziato stated that there was a category for rooming and boarding houses and this criteria is met. He further explained that the whole issue of group homes is under study and should be completed shortly. Mrs. Castello stated that she felt this action to request the group home was premature and she did not feel it was adequately covered in the code. She asked that this request be denied. Geraldine Pleasanton, 112 S.W. 3rd Avenue, lives across from the proposed site for the group home. She felt that the group homes must have a place, but did not agree that the one proposed was a proper place. She referred to the large amount of traffic on Seacrest and felt that the home would only add to the already existing traffic problems. As no one else wished to speak in favor of or against the request, the PUBLIC HEARING WAS CLOSED. Mr. Richter felt that there was a need for group homes and R-3 was an area which would give the opportunity for them. Mr. Annunziato stated that he had heard much negative com- ment regarding the group home issue. There were concerns - 5 - MINU~ES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 14, 1988 about the impact on neighborhoods and whether or not Boynton Beach was being asked to take care of more than their share. He felt that this was an ideal location for the girls as the area is zoned R-3 and is across from the Library. ~e further pointed out that staff had felt that group homes should perhaps be located in single family home areas in order to provide for a "normal" family atmosphere for the girls. He felt that this particular piece of property was well suited for a group home, and that an opportunity such as this might not come up again in the near future. Chairman Walshak agreed with Mr. Annunziato and noted that he had attended the workshops where groups homes were discussed, and noted that group homes must be accepted in Boynton Beach. Vice Chairman Blanchette was concerned about what could hap- pen to the property in the future if it received approval at this time. Mr. Annunziato stated that the conditions were spelled out and this was a specific request for a specific purpose for specific conditions. Chairman Walshak stated that he had gone to the property in Golfview ~arbor after the City Commission meeting. Be found the group home to be better maintained than other homes in the area. Mrs. Buckle was glad to have that clarified as the only information she had was the negative comments made at the City Commission meeting by the neighbors in Golfview Harbor. She felt that the noise level could be supervised and should prove to be no real problem. Mrs. Weiner moved to approve the request for conditional use to permit a group home for four (4) emotionally disturbed girls between the ages of 14 and 16 located at South Seacrest Boulevard at S.W. 3rd Avenue, northwest corner, sub- ]ect to staff comments. Motion was seconded by Mrs. Huckle and carried 7-0. West side of North Congress Avenue, south of N.W. 22nd Avenue Tract A of Catalina Centre - Plat No. 2 Request for site plan and con- ditional use approval to construct a 90 seat (4,295 square foot) -6- MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 14, 1988 restaurant with a drive-through win- dow on a leased outparcel within Plat No. 2 at Catalina Centre. Miss Heyden explained that C-3 zoning allows for drive through restaurants. She further explained the exact loca- tion of the proposed site. The ma3or problems with this request relate to traffic flow and the fact that the drive- through windows are visible from Congress Avenue. It was feared that the drive-through would cause traffic congestion. No provisions were made for customers going through the drive-through window who must park and wait for their orders to be filled. There were also problems with allowing two signs for the drive-through windows, as well as a setback problem. The building is aesthetically pleasing and the Board members agreed it was beautiful. Miss Heyden explained that the problem brought up by the Fire Department had not been addressed properly. The applicant does not wish to install a sprinkler system. (See staff comments attached as Addendum B to the original copy of these minu- tes in the office of the City Clerk.) Tommy McMurrian; Walboyn, Inc., stated that Walboyn had refused to al,low the request from McDonald's when they came forward with their initial plan. McDonald's persisted and came up with several alternate plans, and Mr. McMurrian began to see that McDonald's was serious about their request and desired to work with Walboyn. He went to Boca Raton to the Crocker Center to see the McDonald's at that location and observe the traffic pattern, etc. He was surprised at how well it worked. Chairman Walshak stated that he felt the traffic problems should have been worked out prior to this coming before the Board. Mr. McMurrian explained that there was only so much that could be done with the limited land available at this location. Mr. Annunziato stated that this was a wonderful looking McDonald's but it did not fit on this piece of property. Chairman Walshak asked if the drive-through windows could be eliminated. Mr. Roland Yates, Construction Engineer, stated that the drive-through provided for 50 percent of their business. He felt that the drive-through would provide a useful service for the citizens of Boynton Beach. He stated that the proposal was for only 90 seats and the building would be 1,000 square feet in size. Mr. Yates further explained that the cooking equipment was equipped with an ancillary system which would protect from fires. They prefer not to install sprinkler systems due to the high costs involved. He felt that access was available for fire fighting equipment and he explained. -7- MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 14, 1988 Mrs. Buckle pointed out that access for fire personnel was not the only problem and she pointed out many code viola- tions. Mr. Yates stated that his company is working with staff to try to reach a solution. Chairman Walshak pointed out that these problems should have been worked out prior to bringing this to the Board. He stated that most of the problems encountered are due to the small size of the site. As this was a public hearing and no one wished to speak FAVOR of the request, Chairman Walshak asked if anyone wished to speak AGAINST the request. ZN Phillip Martin, 211 S.W. 5th, stated that he felt Walboyn only wanted to bring in McDonald's so that more business would be generated for Catalina Centre. He pointed out that Boynton Beach already has a McDonald's on Federal Highway and one on Military Trail and could not see why another one was needed. As no one else wished to speak, THE PUBLIC HEARING WAS CLOSED. Mrs. Huckle stated that normally she would deny such a request as the applicant had not worked out problems with staff prior to bringing it to the Board. In this case the applicant has ignored many of the City's codes as well. She agreed that the building being presented was beautiful and suggested that the applicant be allowed to go back and work out some of the problems with staff. Chairman Walshak pointed out that the applicant had received some of the comments at this meeting and felt that he should be allowed some time to work out these problems with staff. He felt the applicant should come back with their traffic engineers to see what can be worked out. Mrs. Huckle moved to table the request for site plan and conditional use approval to construct a 90 seat (4,295 square foot) restaurant with a drive-through window on a leased outparcel within Plat no. 2 at Catalina Centre located on the west side of North Congress Avenue, south of N.W. 22nd Avenue in order to allow the applicant to meet with the Technical Review Board in an attempt to resolve the problems associated with this request. Motion was seconded by Dr. Jackier and carried 7-0. After a short break the meeting resumed at 9:10 P.M. -8- MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 14, 1988 B. Mr. Golden explained that this is rental property and this is the second of the four steps required for project appro- val. The Technical Review Board (TRB) recommended approval subject to staff comments (attached as Addendum D to the original copy of these minutes in the Office of the City Clerk). Mrs. Huckle was concerned about the traffic signal, but Mr. Golden explained that would be addressed with the site plan approval. Bill Brisben, W.O. Brisben Companies, Inc. stated that they are in compliance with R-3 zoning. They are making a long term investment in this area and have been working closely with staff and will continue to do so. Be was in agreement with all staff comments and stated that those comments would be addressed in the final site plan. Mr. Brisben stated that the buildings will consist of about one-third of the units as one bedroom apartments approximately 754 square feet in size renting for approxi- mately $585 a month. The remaining two-thirds are two bedroom units of 1,050 square feet in size and would rent for approximately $785 a month. Vice Chairman Blanchette moved to approve the request for master plan approval to construct 199 multi-family rental apartment units on 18.86 acres located at the North side of West Boynton Beach Boulevard, between Old Boynton Road and the L.W.D.D. E-4 canal, subject to staff comments. Motion was seconded by Mrs. Huckle and carried 7-0. -9- MINUTES -~PLANHING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 14, 1988 MASTER PLAN MODIFICATIONS 2. Mr. Golden explained that this request would allow solid roofs to be installed on the screened enclosures and reduce the setback from 15 feet to 8 feet for those units abutting the L-20 canal. The TRB recommended approval subject to staff comments (attached as Addendum E to the original copy of these minutes in the Office of the City Clerk). On May 17, 1988 the City Commission made a finding of no substantial change and sent this to the P&Z Board for final consideration. Mr. Golden stated that the applicant has agreed to a 10 foot setback rather than the 8 foot setback requested. Mrs. Huckle moved to approve the request for approval of an amended master plan to allow for a 5 foot reduction in the rear setback (from 15 feet to 10 feet) to permit the addi- tion of solid roofs on screened enclosures for property located on the west side of North Congress Avenue, south of Hypoluxo Road, with the f,inding of no substantial change and subject to all staff comments. Miss Heyden explained that this request was for a modifica- tion to the approved master plan and requested that front yard setbacks for certain units be restored to 20 feet (from 25 feet) consistent with the master plan approved at the time of rezonlng. The TRB recommended this be approved and on June 7, 1988 the City Commission made a finding of no substantial change and that it be forwarded to the P&Z Board for final con- sideration. Mr. Menendez was available for questions. Mrs. Huckle moved to approve the request for approval of an amended master plan to reduce the front yard setbacks for certain units from 25 feet to 20 feet for Citrus Glen Limited Partnership located on Lawrence Road at Miner Road extended, southeast corner, with the finding of no substan- tial change. Mr. Golden stated that this request had been reviewed by the Environmental Review Committee and the owner stated that no concrete would be mixed on site. Sand and gravel will be stored and the silo will store only the mix for concrete. The TRB recommended approval subject to staff comments (attached as Addendum F to the original copy of these min- utes on file in the Office of the City Clerk). Kevin Cornnell was available to answer questions. Mr. Menendez explained that the Citrus Glen signs requested would identify the community. Citrus Trail and Executive Estates are two areas located within Citrus Glen. He pre- sented colored renditions of the proposed signs and pointed out locations for their installation. The TRB recommended approval subject to staff comments (attached to the original copy of these minutes as Addendum G in the Office of the City Clerk). Mr. Menendez was aware of the new sign code and stated that the size of the sign could be reduced if necessary. Mrs. Huckle moved to approve the request for site plan approval to construct entrance wall signage, roadway buffer walls, and related landscaping located at Lawrence Road at Miner Road extended, southeast corner, subject to staff com- ments. Herman's Sporting Goods will be the first tenant for this retail "L" shaped shopping center and will occupy approxi- mately 1/4 of the building. The building will be white stucco with green bands and red canopies. There will be a traffic light on Congress. The TRB recommended approval subject to staff comments (attached as Addendum H to the original copy of these minutes in the Office of the City Clerk). The owner was available for questions. There was some discussion regarding changes to the drawings after TRB had reviewed them. Mr. Annunziato did not feel these changes would cause any problems as they were not struct- ural. The applicant had no problem complying with staff comments. Mr. Richter moved to approve the request for site plan approval to construct a 42,310.5 square foot retail shopping center on 3.8656 acres on the west side of North Congress Avenue, north of Old Boynton Road, subject to staff com- ments. Mr. Zlmmerman explained that since this is a spec. building, the doors and window arrangements have been left so that the tenant can decide the best location for them. Everything else is complete. He told what the color of the building would be and the design. The architectural drawings will be available for the Community Appearance Board meeting to be held on June 20th. There was further discussion regarding the unavailability of the drawings. Chairman Walshak felt that this size, it was too much design would be included. when dealing with a project of to expect that the door/window Mr. Zimmerman requested that he be allowed to delete the hedge at the edge of his property line. He explained that it was their intent to take advantage of the lake view, and technically his property line was in the middle of the lake. The City Forester stated that the master landscape plan showed 5442 hardwood species planted along the lake fronts, and Mr. Zimmerman felt this would be adequate landscaping. Mr. Annunziato stated this was a code requirement and the CAB should review this request. Vice Chairman Blanchette made a motion to act on this request even though the architectural drawings were not available with the stipulation drawings would be available prior to the City Commission Meeting.
