A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
APPROVING THE AWARD OF CONTRACT TO
CONSTRUCT A DEEP INJECTION WELL DISPOSAL
SYSTEM FOR THE WEST WATER TREATMENT
PLANT; AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE THE CONTRACT FOR
CONSTRUCTION OF THE DEEP INJECTION WELL
DISPOSAL SYSTEM, WHICH IS ATTACHED
HERETO AS EXHIBIT "A"; AND PROVIDING AN
EFFECTIVE DATE.
WHEREA~, the City has received bids for construction of
he deep injection well disposal system; and
WHEREAS, Youngquist Brothers, Inc. submitted a low bid
f $2,098,650.00 to construct the proposed project; and
WHEREAS, it has been determined by the City Commission
o be in the best interest of the citizens and residents of
:he City of Boynton Beach to select the bid of Youngquist
~rothers, Inc.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
THE CiTY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of
;oynton Beach, Florida hereby approves the award of contract
.o construct a deep injection well disposal system for the
Iest Water Treatment Plant.

~ITNESSETH:

~ner and of the covenants and agreements herein contained, hereby
~rees at his own proper cost and expense to do ~11 the work and
t~rnish all the materials, tools, labor, and all appliances,
machinery, and appurtenances for the construction of a reinforced
concrete drilling pad, 4 shallow groundwater monitor wells, an
injection well, and dual-zoned Floridan aquifer monitor well, to the
ex=ent of the Proposal made by the Contractor, dated the 16th day
of January 19__~_., all in full compliance wi--~the
C~ntract Documents referred t~ herein.
The BIDDING REQUIREMENTS, including the signed copy of the Proposal,
the CONTRACT FORMS, the CONDITIONS OF THE CONTRACT, the
SPECIFICATIONS, and the DRAWINGS, are hereby referred uo and by
reference made a part of this Contract as fully and completely as if
t~e same were fully set forth herein and are mutually cooperative

herein and to accept as full payment hereunder the amounts computed
as determined by the Contract Documents and based on the said
Proposal.

The Con~ractor agrees to remedy all defects appearing in ~he work ~r
developing in the materials furnished and the workmanship performed
under this Contract during the warranty period after the date of
final acceptance of the work by the Owner, and further agrees ~o
indemnify and save the Owner harmless from any costs encountered in
remedying such defects.
It is agreed that the ContracT, based upon the Proposal, shall be
fully complete within 240 consecutive calendar days from the date
the Notice to Proceed is issued.
In the event ~hat the Con~rac~or shall fail to complete the work
within the time limit or the extended time limit agreed upon, as
more particularly set forth in the Con~rac5 Documents, liquidated
damages shall be paid at the rate of $200 per day plus any monies
paid by the Owner to the Engineer for any additional engineering and
inspection services associated with such delays. Sundays and legal
holidays~shall be included in determining days in default.
