ACCEPTING THE PUBLIC ROAD RIGHTS-OF-WAY

PAGES 129-14:1, OF THE PUBLIC RECORDS OF
PALM BEACH COUNTY, FLORIDA; PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING AN
EFFECTIVE'DATE.

WHEREAS, City installed street lights on these streets
n 1979; and
WHEREAS, City has maintained these streets for 15
ears, as far as paving, patching, repair of sidewalks and
leaning of drains; and
WHEREAS, sidewalks extended by City through swale areas
o comply with Public Safety Code in 1989; and
WHEREAS, the City desires to hereby formally accept and

ecord in the public records of Palm Beach County its
cceptance of road rights-of-way.
NOW, THEREFORE, BE IT R.ESOLVED BY THE CITY COMMISSION
F THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1.
The foregoing "WHEREAS" clauses are
ereby ratified and confirmed as being true and correct and
re hereby made a specific part of this Resolution.
Section 2.
That the City hereby accepts the public
road rights-of-way dedicated by and shown on the "Palm Beach
eisure Section 10 Plat" recorded on December 13, 1973, in
lat Book 30, Pages 129 to 141 of the Public Records of Palm
Beach County I Florida; and more particu.larlydescribed in
IEXhibit 1 attached hereto and by this reference made a part
hereof.
Section 3.

Section 4.
That
all
resolutions
or
parts
of
ORB 6695 P9 227
resolutions in conflict herewith be and the same are hereby
repealed.
Section 5.
In the event any portion of this
Resolution is deemed invalid, illegal or unconstitutional by
any court of competent jurisdiction, such decision shall in
no manner effect the remaining portions or sections of this
Resolution and shall remain in full force and effect.
Section 6.
This Resolution shall become effective
immediately upon its passage and adoption.
